RECOMMENDATION
Staff recommends the City Council adopt a Resolution declaring the intention to order the vacation of 543 square feet of the portion of Drakewood Avenue fronting 10701 Drakewood Avenue, Tract No. 18215 and setting the public hearing to consider such vacation on April 14, 2025.
BACKGROUND/DISCUSSION
The homeowners of 10701 Drakewood Avenue petitioned the City to vacate a sliver of public right of way (543 square feet) in order for it to align with the existing long term improvements, mainly fencing, behind the back of the curb. A records search determined that the aforementioned property owners own the underlying fee to this portion of Drakewood Avenue. (Attached is Exhibit A legal description and Exhibit B proposed street vacation area.
The State law governing street vacations is the Streets and Highway Code §§8300 to §§8836 et. seq. This law requires the City Council adopt a Resolution of Intention to set the public hearing date for the vacation of the portion of street. For the final City Council hearing adopting the vacation, the State law requires a notice of hearing to be posted in the local newspaper at least two successive weeks prior to the hearing and at least two weeks prior to the final hearing the area to be vacated shall be conspicuously posted.
Should the City Council adopt the Resolution of Intention, then staff will prepare the notice required by State Law and also provide a courtesy notice to property owners and residents located within a 500-foot radius of the area proposed to be vacated. All utility companies will be notified if the City Council adopts the proposed Resolution.
FISCAL ANALYSIS
There is a fiscal impact to publish the notices of the public hearing in the newspaper in the amount of approximately $620. The Adopted Budget for Fiscal Year 2024-2025 contains sufficient funding to cover the cost in Account No. 10160150.514100 (Public Works Engineering - Departmental Special Supplies) which can be found in the Public Works section of the budget book on page 408.
