RECOMMENDATION
Staff recommends the City Council (1) adopt a resolution to enter into a Grant Agreement with the State Water Resources Control Board to receive grant funds in an amount not-to-exceed $233,157 for the Citywide Bioretention Basin Project.
BACKGROUND/DISCUSSION
Proposition 50 - the Water Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 - allocated $100 million to the State Water Resources Control Board (State Water Board) to finance projects to restore and protect the water quality and environment of coastal waters, estuaries, bays and near-shore waters, and groundwater. Of that $100 million, Section 79543, subdivision (c) of the Water Code allocated $20 million to implement priority actions specified in the Comprehensive Conservation and Management Plan (CCMP) of the Santa Monica Bay National Estuary Program (NEP), formerly known as the Santa Monica Bay Restoration Plan. The Commission released an RFP in June 2021 to solicit projects with a water quality monitoring component for funding.
In response to this RFP, City staff submitted an application for a newly created Citywide Bioretention Basin Project, to install green infrastructure consisting of rain gardens, bioswales, and associated curb, gutter and roadway improvements in eight locations throughout the City. As part of the required Municipal Separate Storm Sewer System (MS4) permit with the Los Angeles Regional Water Quality Control Board, the City must address water quality and various TMDL (total maximum daily load) pollutant levels through a variety of projects and mitigation measures. After two public outreach workshops in June 2021, on August 23, 2021, City Council approved the City’s Stormwater Quality Master Plan (SWQMP), a planning tool that analyzed the City’s drainage patterns, geotechnical characteristics, groundwater levels and other data to create 400 potential project opportunities to achieve compliance. The bulk of this compliance will be achieved through green street installations, where stormwater and dry-weather runoff is captured prior to entering the storm drain system. Depending on site characteristics, the runoff may be retained or infiltrated through the use of green infrastructure such as bioswales or rain gardens.
The locations selected from the SWQMP for this project were portions of Berryman Avenue, Galvin Street, Jasmine Avenue, Northgate Avenue, Pickford Way, Revere Place, Segrell Way and Wesley Street. Staff will select a consultant to assist with the public outreach and the design phase of the project in spring 2022 to determine if these locations are appropriate for project implementation.
In order to receive Prop 50 grant funds, the City Council must adopt a resolution to enter into a funding agreement with the State Water Resources Control Board, and authorizing the City Manager or their designee to be the City’s representative for the project.
FISCAL ANALYSIS
There is no fiscal impact at this time as the Citywide Bioretention Basin Project will be created as part of the FY 2023 CIP budget process and will be assigned a new project number at that time.

That the City Council:
1. Adopt a resolution to enter into a Grant Agreement with the State Water Resources Control Board to receive grant funds in an amount not-to-exceed $233,157 for the Citywide Bioretention Basin Project;
2. Authorize the City Attorney to review/prepare the necessary documents; and
3. Authorize the City Manager to execute such documents on behalf of the City.
