RECOMMENDATION
Staff recommends the City Council (1) approve an agreement with MOEV, Inc. for charge management solutions in an amount not to exceed $527,244; and (2) adopt a resolution certifying the Project will be completed by a skilled and trained workforce and determining an exemption from the California Environmental Quality Act (CEQA) is appropriate for receipt of awarded grant funds from the California Energy Commission (CEC) (Attachment 1).
BACKGROUND/DISCUSSION
Agreement with MOEV
As part of the proposed award from California Energy Commission (CEC) in August 2021 for the Transportation Facility Electrification Project, the Transportation Department named MOEV as a strategic partner in its application. The use of strategic partnerships within the context of grant applications is common within major infrastructure grant programs, especially those that are evolving and require pilot programs. MOEV was identified to provide a customized pilot charging and energy management software solution that will integrate all energy and electric vehicle data, provide reports and alerts to relevant individuals, and provide other data. The System will optimize the efficiency, reduce cost and increase resilience for charging the City’s battery electric buses and vehicles, and personal vehicles. Additionally, the system will integrate on-site solar generation and facility battery energy storage to minimize costs and provide additional resilience benefits across the three electricity meters at the Transportation Site. The agreement with MOEV will be for the development and operational use of the software for four years.
Pursuant to Culver City Municipal Code Section 3.07.055.E, competitive bid requirements shall not apply where items to be purchased are computer software, hardware maintenance services or software maintenance services. The system and services provide by MOEV fall within this exception.
CEQA Resolution
Transportation staff has worked to prepare all required components in order for the City to be fully awarded its grant from the CEC for the Transportation Facility Electrification Project. A pre-condition of the full award is a resolution providing for compliance with the California Environmental Quality Act (CEQA). An exemption is appropriate for receipt of awarded grant funds pursuant to Public Resources Code Section 21080.25, which provides exemptions for the conversion of facilities to house and charge battery electric buses. Further, any subsequent approvals would be subject to appropriate CEQA analysis.
Upon City Council’s adoption of the proposed Resolution (Attachment 1), staff will file a Notice of Exemption (NOE) with the Los Angeles County Clerk. Based on discussions with CEC staff, after the expiration of 35 days from the date of filing of the NOE, the City will have met all requirements to be placed on the CEC’s business meeting docket on April 13, 2022 for final approval of the grant award.
FISCAL ANALYSIS
Costs associated with the MOEV software will be paid from budgeted capital funds in project account 20380000.619800.PB002. Proposition C Discretionary allocations in the amount of $151,200 will be used as the local match for the project. Project activities may only commence after the full award of grant funds on April 13, 2022. The City will receive grant funds on a reimbursable basis. No general funds will be used in this project.

2. Authorize the City Attorney to review/prepare the necessary documents;
3. Authorize the City Manager to execute such documents on behalf of the City; and
4. Adopt a Resolution certifying the Project will be completed by a skilled and trained workforce and determining an exemption from CEQA is appropriate for receipt of awarded grant funds.
