RECOMMENDATION

 

Staff recommends the City Council approve a four-year agreement with Downstream Services Inc., for operations and maintenance services of Culver Boulevard Stormwater Treatment and Retention Facility in an  amount not-to-exceed $150,000 in FY 2021/2022 and an annual not-to-exceed amount of $300,000 for FY 2022/2023 through FY 2024/2025.

 

 

BACKGROUND/DISCUSSION

 

On December 28, 2012, the Los Angeles County Municipal Separate Storm Sewer System Permit (MS4 Permit) became effective in accordance with the Clean Water Act.  The Los Angeles MS4 Permit covers unincorporated areas of Los Angeles County, the Los Angeles County Flood Control District, and 84 cities within Los Angeles County, including the City of Culver City.  The City’s compliance efforts include various minimum control measures such as public outreach, construction and demolition recycling program, street sweeping, and polystyrene ban, and larger regional projects such as the Culver Boulevard Stormwater Treatment and Retention Project.

The Culver Boulevard Stormwater Treatment and Retention Project consists of a retention basin and filtration system to capture and treat stormwater/urban runoff from approximately 796 acres of drainage area. A portion of the captured run-off is stored in an underground retention basin and used to supplement the required irrigation for the proposed landscaping along Culver Boulevard.  The excess captured run-off is filtered and discharged back into the Harter Avenue storm drain downstream of the project as treated water, in compliance with the City’s Municipal Separate Storm Sewer System (MS4) permit. 

 

The project broke ground in February 2020 and construction will finalize in February 2022, at which point a specialized operations and maintenance program will be initiated to ensure that the project remains properly maintained and in optimal working condition.  The project’s Operations and Maintenance program outlines the cleaning and maintenance interval of the various project components, including two pre-treatment units, diversions, and filtration units, as well as the pump station.

 

Environmental Programs released RFP #2226 on November 4, 2021. One proposal was received on December 9, 2021 via PlanetBids. Staff reviewed the proposal and determined per Culver City Municipal Code Section 3.07.065.D that Downstream Services, Inc.’s proposal met all of the City’s requirements.

 

Downstream Services, Inc.’s proposal is based on the recommended cleaning and servicing intervals outlined in the project’s Operations and Maintenance Manual, with contingency built in for additional cleanings required by heavier than normal rainfall.  Actual costs will be based on time and materials costs of work performed.

 

The project is a partnership with the City of Beverly Hills, which contributed $3,500,000 towards the construction of the project.  The Los Angeles Regional Water Quality Control Board authorized a “Structural Best Management Practice (BMP) Capacity” credit for Beverly Hills in exchange for Beverly Hills’ financial contribution toward the Project under Section 7.1 of the Ballona Creek Enhanced Watershed Management Plan (EWMP).  The credit provided to Beverly Hills is attributed to its retention requirement under the EWMP Plan despite the Project’s location outside of Beverly Hills’ boundaries and subwatershed.  A separate MOU will come before Council for the cost share by Beverly Hills of the Operations and Maintenance, which is estimated to be 23% of the annual costs, based on the proportional structural BMP capacity.

 

FISCAL ANALYSIS

 

Funding for this agreement is budgeted for the remainder of FY 2021/2022 in account   43480000.730100. Future funding is contingent upon budget authorization. The annual amount for FY 2022/2023 through 2024/2025 is not-to-exceed $300,000.

MOTION

 

That the City Council:

 

1.                     Approve a Four-year Agreement with Downstream Services, Inc. for Operations and Maintenance of Culver Boulevard Stormwater Treatment and Retention Facility in an amount not-to-exceed $150,000 for FY 2021/2022 and an annual not-to-exceed amount of $300,000 for FY 2022/2023 through FY 2024/2025; and

 

2.                     Authorize the City Attorney to review/prepare the necessary documents; and

 

3.                     Authorize the City Manager to execute such documents on behalf of the City.
