RECOMMENDATION

 

Staff recommends the City Council approve an amendment to the existing professional services agreement with NV5 for construction management and inspection services in an amount not-to-exceed $235,548 for the Construction of Diversion Sewer Pipes to Abandon Mesmer and Overland Sewer Pump Stations, Project No. PZ-946.

 

 

BACKGROUND/DISCUSSION

 

On March 18, 2019, the City Council (1) awarded a construction contract in the amount of $11,732,055 to Ramona Inc, for the construction of Diversion Sewer Pipes to Abandon Mesmer and Overland Sewer Pump Stations, Project No. PZ-946; and 2) approved a professional services agreement in an amount not-to-exceed $419,865 (plus $42,000 contingency amount) to NV5 for construction management and inspection services.

 

The completion of this project will allow the sewer flow from Mesmer Station and Overland Station be diverted to the newly completed Bankfield Station. The Mesmer Station is proposed to be repurposed to a low flow diversion project. The low flow diversion system will capture dry weather run-off from Centinela Creek into Mesmer Station where the run-off will be pumped into an existing sewer main for conveyance to City of Los Angeles’ Hyperion Treatment Plant for treatment.

 

The project has experienced delays from the permitting agencies.  Much of the project delays were beyond the control of the City or the Contractor, resulting from delays in securing staging areas in a residential neighborhood that would be compatible with night time work as required by the City of Los Angeles permit condition and soils storage, along with reacquiring the expired Caltrans permits for the work within the Caltrans right-of-way.

 

While the staging area was ultimately resolved by the Contractor, the issuance of the Caltrans permit took a long time and resulted in decoupling of the construction schedule off the original critical path. The Contractor began construction in November 2019 and made every effort to complete whatever work was possible outside the Caltrans right-of-way, and ultimately stopped work in mid May 2020 as the Contractor had completed all work outside the Caltrans right of way and needed the Caltrans double permit to continue working. Since that time, the Contractor and the City have successfully obtained the permits from Caltrans and work commenced within the Caltrans ROW in August 2020.  Three hundred thirty (330) calendar days was required to complete the project.  However, because of permit delays beyond the contractor’s control as described above, a no cost change order was approved by the Public Works Director/City Engineer to extend the construction period by three hundred seventeen (317) calendar days with an estimated ending date in May 2021.

 

Due to the aforementioned outside agency permitting delays and also unexpected night work required by the City of Los Angeles, the project duration was extended beyond the original contract requirement. NV5 has been assisting the City  keeping the project moving, and has exhausted the original budget amount.  Construction management and inspection services are required through the end of May 2021.  NV5 is requesting $235,548 of additional fees to cover November 2020 through May 2021 for the additional services estimated necessary to provide continued services through project completion. The final additional fee will be based on the actual time expended by NV5 on the project.

 

The original change order authority as approved by the City Council at the time of contract award to NV5 is $42,000.  Since then staff engaged NV5 to provide engineering services and obtain a permit from the City of Los Angeles to construct a connection of the second forced main from Bankfield pump station to the Los Angeles North Outfall Sewer (NOS) in the amount of $22,958, leaving a remaining balance of $19,042 for any other unforeseen conditions.

MOTION

 

That the City Council:

 

1.                     Approve an amendment to the existing professional services agreement with NV5 for additional construction management and inspection services in an amount of $235,548 for the construction of Diversion Sewer Pipes to Abandon Mesmer and Overland Sewer Pump Stations, Project No. PZ-946; and,

 

2.                     Authorize the City Attorney to review/prepare the necessary documents; and

 

3.                     Authorize the City Manager to execute such documents on behalf of the City.
