RECOMMENDATION
Staff recommends the City Council (1) award a contract in the amount of $422,657.50 to CEM Construction Corporation, as the lowest responsive and responsible bidder, for the construction of Community Development Block Grant (CDBG) Sidewalk Barrier Removal & Repair Project (CDBG Project No. 602150-19& 602154-19) and Concrete Curb and Gutter, Sidewalk, and Curb Ramps Project (Project No. PZ-428); and (2) authorize the Public Works Director/City Engineer to approve change orders in an amount not-to-exceed $63,398 (15%); and (3) approve a related budget amendment in the amount of $91,595 (requires four-fifths vote).
BACKGROUND/DISCUSSION
CDBG Sidewalk Barrier Removal & Repair Project (CDBG Project No. 602150-19 & 602154-19)
On June 24, 2019 the City Council approved and adopted the Community Development Block Grant (CDGB) fund allocation for Fiscal Year (FY) 2019/2020, Resolution No. 2019-R048. The project scope includes replacing uplifted non-ADA compliant sidewalks Citywide. Sidewalks identified for replacement are located in the Fox Hills neighborhood area, Ocean Drive, Elenda Street, Overland Ave at Jefferson Blvd, Cardiff Ave, Ince Blvd and Lindblade Street.
Also, the scope of work includes replacement of non-ADA compliant concrete walkways and construction of concrete pads to allow drinking fountain accessibility, at various city parks.
In addition, the project scope includes removing obstructions on the sidewalk along Jefferson Blvd between Hetzler Rd and Pearson Street and construction of curb extension at 10119 Jefferson Blvd to allow for the ADA required minimum sidewalk clearance.
Concrete Curb Ramps, PZ-428
This project proposes the construction of 11 new ADA curb ramps along at the following locations to serve existing/future crosswalks and allow greater pedestrian access to San Marino Elementary School and El Rincon Elementary School:
• Hayter Ave/Sawtelle Blvd - 2 curb ramps
• Diller Ave/Culver Park Drive - 1 curb ramp
• Culver Park Place/ Culver Park Drive - 1 curb ramp
• Port Road/Hayter Ave - 2 curb ramps
• Coolidge Ave/Port Road - 1 curb ramp
• Berryman Ave/Ryandale Drive - 2 curb ramps
• Berryman Ave/Port Road - 1 curb ramp
• Overland Ave/Sawtelle Blvd - 1 curb ramp
Also, the scope of work includes the installation of crosswalks, striping and stop sign relocation associated with the new curb ramp construction.
Concrete Curb and Gutter, Sidewalk Improvements, PZ-428
This proposed project includes replacement of uplifted sidewalks and curb and gutter at the following locations:
• 9632 and 9646 Lucerne Ave
• 11131 Barman
• 10710 and 10724 Oregon Ave
• 4265 Baldwin Ave
• 4044 Huron Ave
Construction Bids:
On September 3, 2020 the City Council approved the plans, specifications and authorized staff to publish a notice inviting bids for the project. The Notice Inviting Bids was published on Culver City PlanetBids website and in the Culver City News on August 13, 2020. Bid opening date was on September 3, 2020. Four contractors responded with the following bid amounts:

* Bid submittal from R Brothers, Inc. was incomplete with missing required bid forms.
Staff reviewed the received contractor bid documents and determined CEM Construction Corporation submitted the lowest responsive total base bid. Staff reviewed the bid proposal and found the bid documents responsive and complete. It’s bond, contractor’s license, and worker’s compensation insurance were reviewed and determined to meet City requirements. CEM Construction Corporation has completed similar projects throughout the cities in southern California. In addition, CEM Construction Corporation has successfully completed the City’s Park to Playa - Ballona Creek Connection project construction in 2018/19.
A proposed construction contingency amount of $63,398 (15%) is requested for unforeseen conditions during construction or to allow additional curb and gutter and sidewalk replacement to be added to this contract.
The Public Works Department Engineering Division staff will perform the construction management and construction inspection of the project.
FISCAL ANALYSIS
This project is funded in the City’s FY 2020/2021 CIP budget. Per Resolution No. 2019-R048 approved by City Council on June 24, 2019, the CDBG fund allocation for FY 2020/2021 will be updated. The fund allocation update consists of transferring $268,693 from project number PS-006 ADA Transition Plan to PS-011 CDBG Sidewalk Barrier Removal & Repair Project.

Per the executed development agreement between Playa Vista Capital and Culver City, $250,000 of traffic mitigation funds were given to the City to address impacts to the Sunkist Park neighborhood. There is $215,291 available in the account. A portion of this project includes improvements in the Sunkist Park Neighborhood of 10 new curb ramps, 11 new thermoplastic crosswalks, and a temporary new curb extension at Port Rd and Hayter Avenue. These improvements will reduce traffic impacts to the neighborhood. The total bid amount for these aforementioned items is $91,595. Staff proposes to use $91,595 of Playa Vista revenue funds for this work in Sunkist Park neighborhood. The City Council will need to approve use of these funds and appropriate $91,595 from Playa Vista/Sunkist Park/NTMP Unappropriated Reserve Account 420.212260 into Account 420080000.730100.PZ428 Improvements other than Building. A four-fifths vote is required to approve this budget amendment.

3. Authorize the City Attorney to review/prepare the necessary documents; and,
4. Authorize the City Manager to execute such documents on behalf of the City.
