RECOMMENDATION

 

Staff recommends the City Council (1) adopt a resolution amending the Bylaws of the Equity and Human Relations Advisory Committee; (2) appoint members to fill the vacant Labor Representative positions of the Equity and Human Relations Advisory Committee (EHRAC) and Finance Advisory Committee (FAC); and (3) rescission of appointment and new appointment to the LAX Area Advisory Committee.

 

 

BACKGROUND/DISCUSSION

 

Amending the Bylaws of the Equity and Human Relations Advisory Committee (EHRAC)

 

The EHRAC is a new advisory body to the City Council and/or the City Manager, established in January 2020 to recommend programs, policies, and activities that promote positive human relations and equitable outcomes and opportunities in all aspects of community life. The membership includes nine members as follows: seven Members-at-Large, one Labor Representative and one Youth Representative.

In reviewing the adopted bylaws (Attachment 1), it was discovered there are no staggered starting terms for the members-at-large, which means all of the terms will end at the same time. To avoid all members terming out at once, staff recommends the initial appointments be for three-year terms for each of the odd-numbered seats (1,3,5 and 7), expiring on June 30, 2023; and four-year terms for each of the even-numbered seats (2, 4 and 6), expiring on June 30, 20204.  Thereafter, all members-at-large will serve four-year terms.

Staff also recommends the term for the youth and labor seats be for a one-year period.  The labor seat will be determined each year by the different bargaining groups and will be provided prior to the first meeting of each fiscal year.

In addition, a provision regarding partial terms has been included.  For consistency with other commissions and committees, staff recommends that a partial term in excess of two years be considered a full term for members-at-large, and a partial term in excess of six months be considered a full term for the labor and youth representatives.

The amended Bylaws reflecting the above changes are included as Exhibit A to the proposed Resolution (Attachment 2).

Equity & Human Relations Advisory Committee Labor Representative Appointment

 

At the June 8, 2020 City Council Meeting, members were appointed to various Commissions, Boards and Committees (CBCs) during the annual process to fill seats.

This included all positions of the new Equity and Human Relations Advisory Committee, except for the Labor Representative position which required additional discussion between the bargaining units. The bargaining units have met and achieved consensus to recommend approval of Lt. Luis Martinez as the Labor Representative for a one-year term, through June 30, 2021.

 

Finance Advisory Committee Labor Representative Appointment

 

Jane Leonard has announced that she will step down from her position as the management labor representative. Section II.A.c.ii of the Bylaws state:

 

“one (1) member may be appointed from either the Culver City Management Group, the Culver City Police Management Group, or the Culver City Fire Management Group. The three groups shall reach a consensus and recommend one individual belonging to any of the groups for the initial term. Beginning October 10, 2016, there be no set terms for this seat. Individuals put forth for City Council approval shall serve a minimum of two years, as long as a majority of the groups are in agreement. Subsequent appointees may belong to any of the groups and shall be recommended based on majority consensus the groups for City Council approval.”

 

The groups met and have reached consensus to recommend Johnnie Griffing as the Labor Representative with no set term limit.

 

LAX Area Advisory Committee - At the June 8, 2020 City Council meeting, five (5) applications were considered to fill three seats  during the annual appointment process. A sixth application from current representative, John Wahlert, was received after the agenda was posted. Kevin Klowden and Luciano Nocera, who have served for several years, were reappointed for Calendar year January 1- December 31, 2021. City Council appointed Lila Swenson to the third position. Ms. Swenson contacted staff to explain that she had inadvertently selected the LAX body from the drop down menu on the application but had meant to reapply to the Fiesta la Ballona Committee, on which she would like to remain through her term ending on October 31, 2020.

 

Staff recommends that City Council rescind the appointment of Lila Swenson to the LAX Area Advisory Committee and appoint a member from the remaining applicants: John Wahlert, Mike Berlin, or Taria Lewis. All have been contacted and remain interested in the position
