RECOMMENDATION
Staff recommends the City Council (1) adopt a Resolution approving a Mitigated Negative Declaration for the Washington Blvd Stormwater Diversion Project, PR001; and (2) approve the Final Plans and Specifications and authorize the publication of a Notice Inviting Bids for the Project.
BACKGROUND
On December 28, 2012, the Los Angeles Regional Water Quality Control Board (LARWQCB) adopted R4-2012-0175, a National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System Permit (MS4 Permit). This latest MS4 Permit establishes waste discharge requirements for stormwater and non-stormwater (urban runoff) discharges within the watersheds of Los Angeles County.
The Marina del Rey (MdR) watershed is a small sub-watershed located in the larger, Santa Monica Bay watershed. The tributary area served by the MS4 Permit that drains to MdR harbor is approximately 1,409 acres and consists of portions of the cities of Culver City and Los Angeles and unincorporated County of Los Angeles (County). The MdR watershed is subject to three Total Maximum Daily Loads (TMDLs); the Santa Monica Bay Nearshore Debris TMDL, the Marina del Rey Harbor Mother’s Beach and Back Basin Bacteria TMDL, and the Toxic Pollutants in Marina del Rey Harbor TMDL. The final compliance is required by 2021.
To comply with the MS4 Permit, the City Council approved the development and implementation of an Enhanced Watershed Management Program (EWMP). The EWMP reviews the watershed as a whole and proposes Best Management Practices (BMPs) for responsible jurisdictions to complete. Furthermore, construction of regional projects that capture, infiltrate, and/or reuse storm flows and urban runoff from an 85th percentile storm event or roughly 1.1 inch of rain are also required.
DISCUSSION
On May 30, 2017, Council approved the professional services agreement for civil design for the Washington Boulevard Stormwater Diversion Project, PR-001.
The Public Works Department’s Environmental Programs and Operations Division (PW-EPO) is proposing a Diversion System Project (Project) to capture stormwater/urban runoff from approximately 42 acres of drainage area (including Costco). The proposed Project was identified as one of 23 regional projects in the MdR EWMP. This drainage area is primarily commercial and residential. The City proposes to capture, treat, and retain the 85th percentile, 24-hour storm event into large storage chambers under Washington Boulevard between Glencoe Avenue and Redwood Avenue. Seventy-two hours following the end of a rain event, the captured volume will then be pumped back into an existing sanitary sewer system conveying the runoff to the City of Los Angeles’ Hyperion Water Reclamation Plant for treatment This project will also divert all dry weather run-off from the drainage area for treatment. Common examples of dry weather run-off are water from over irrigation of landscaping, broken irrigation lines on private property, washing of vehicles, and flushing of fire hydrants.
Public Outreach
On November 8, 2018 a public outreach meeting for Washington Boulevard Stormwater Diversion Project was held at Coeur d’Alene Avenue Elementary School Auditorium. There were a total of 8 people that attended the meeting. Invitations to the public meeting were distributed to the immediate Culver City and City of Los Angeles businesses, residences, and local schools via postcard and email subscribers through our City’s GovDelivery system, and Social Media outlet (Nextdoor, Twitter, and Facebook).Staff will coordinate an additional public outreach meeting in March to discuss the construction schedule, construction hours, and traffic impacts. In addition, staff will be distributing information and meeting one on one with business owners and/or managers located within the scope of the project along Washington Boulevard.
CEQA
Pursuant to the California Environmental Quality Act (CEQA) guidelines, an Initial Study (IS) prepared for the project determined that the project will not have a significant adverse impact on the environment with mitigation incorporated and that a Mitigated Negative Declaration (MND) finding is appropriate.
The Notice of Intent (NOI) to Adopt a Mitigated Negative Declaration was published through County of Los Angeles Recorder’s Office in Norwalk, and Culver City News on December 13, 2019. In addition, the NOI was also mailed out to the immediate Culver City and City of Los Angeles businesses, residences, and local schools.
A digital copy of the proposed IS/MND as well as other documents concerning the project are available for public review on the City’s website under City Projects. A hard copy of the IS/MND was available for review by the public at the Engineering Division Counter, City Hall and Culver City Julian Dixon Library during the required public review period. Staff did not receive any comments on the draft IS/MND.
Staff recommends City Council adopt the Resolution adopting the Mitigated Negative Declaration for the Washington Blvd Stormwater Diversion Project, PR001.
Permitting
In December 19, 2016, City of Los Angeles Bureau of Sanitation approved the discharge of wet weather and dry weather run-off into their sanitary sewer system provided that discharge occur after 72 hours of a rain event.
Construction permit for the sewer connection is currently under review and the City anticipates approval from City of Los Angeles Department of Public Works by February, 2019.
This Project is anticipated to begin July, 2019.
FISCAL ANALYSIS
The project is funded by Safe & Clean Water Protection Fund, LA County Open Space & Park Grant Funds (Prop A) and contributions from a Public/Private Partnership with Costco.
Proposition A Grant Award
In February 2016, the City executed a grant agreement with the Los Angeles County Regional Park and Open Space District for an amount of $767,136.
Costco Public Private Partnership
In January 2017, the City executed a cost-sharing Memorandum of Understanding with Costco Wholesale Corporation (Costco) for their fair share in the amount of $1,405,000 for the Project. Costco is currently reviewing an amendment to the MOU for an additional $735,000 to be added to Costco’s fair share to cover the cost for increasing the volume capacity of the pre-treatment system to pre-treat run-off from the Costco property.
