RECOMMENDATION
Staff recommends the City Council adopt an Ordinance (Attachment No. 1) approving Zoning Code Amendment P2018-0191-ZCA related to special event centers.
BACKGROUND
On Wednesday, November 14, 2018, the Planning Commission held a public hearing and recommended the City Council approve the Zone Amendment with the provisions that:
• Existing language related to opening receptions for art galleries remain unchanged in Chapter 17.520 Temporary Use, Special Events and Temporary Event Permits under section B-4;
• Exempts events held in Special Event Centers as defined by the Municipal Code from obtaining special event permits for special events;
• Language be added to indicate that special events under 12 per year are parked as event centers as prescribed in Section 17.320.020;
• Removing proposed language which required art galleries to be considered special event centers if over a certain square footage and to meet certain additional building and fire code standards;
At the City Council meeting of January 14, 2019, the City Council unanimously introduced the proposed Ordinance Zoning Code Amendment P2018-0191-ZCA
Pursuant to City Council’s direction, the proposed Ordinance includes following additional changes to Section 17.520.035(C) (3) (d) of Exhibit A:
• “Event staff shall utilize at least one 3-yard plastic recycle bin, one 3- yard plastic refuse bin, and one green waste bin sized to Public Works Environmental Programs and Operation Division standard, which must be located and filled within the interior of the Event Center building. After each event, all bins must be located on the outside of the Event Center building for City trash pick-up operations.”
The proposed Ordinance is brought back for adoption by the City Council.
ENVIRONMENTAL DETERMINATION:
Pursuant to Section 15061(b) (3) of the California Environmental Quality Act, the proposed Zoning Code Amendment (P2018-0191-ZCA) is considered exempt because it can be seen with certainty that there is no possibility that the Project to amend the Zoning Code will have a significant effect on the environment. The Project by itself, does not result in any physical changes in the environment because it will only amend the Zoning Code to clarify regulatory standards for special events, and does not result in an intensification of development beyond what the Zoning Code already currently allows.
FISCAL ANALYSIS:
The adoption of the proposed Ordinance does not create a fiscal impact.
