RECOMMENDATION

 

Staff recommends the City Council conduct a public hearing and adopt a Resolution ordering the vacation of air rights over a portion of La Cienega Boulevard, for the purpose of a new Pedestrian Bridge for the Park to Playa Trail Project, pursuant to Chapter 3, Part 3, Division 9 of the Streets and Highways Code.

 

 

PROCEDURE:

 

1.                     Mayor seeks motion from City Council to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and,

 

2.                     Mayor calls for a staff report, and the City Council Members may pose questions to staff as desired; and,

 

3.                     Mayor seeks a motion to open the public hearing; and

 

4.                     Mayor seeks a motion to close the public hearing after all public testimony has been presented; and,

 

5.                     The City Council discusses the item and arrives at its decision.

 

 

BACKGROUND:

 

The Park to Playa Trail is a planned 13-mile regional trail that will connect a network of trails, parks, and open spaces from the Baldwin Hills Parklands to the Pacific Ocean.

 

The proposed project will include the installation of a new bicycle, pedestrian and wildlife bridge across La Cienega Boulevard, 600 feet south of Wrightcrest Drive.  The new bridge will require the relocation of utility lines from overhead to underground.  Preliminarily the proposed Pedestrian Bridge will be steel truss, 8 foot by 12 foot wide box.  It will be single span (no columns) across La Cienega Boulevard.  It will be about 23 feet above La Cienega Boulevard.  Another span of the Bridge will continue to the west of La Cienega Boulevard and connect to an existing new trail that was recently opened.  Also the proposed Bridge will connect to existing trails in Kenneth Hahn State Park.  The final design has not yet been completed and some of the aforementioned information may change. 

 

Other trail segments are in the process of being delivered by a combination of the County Department of Parks and Recreation and the Mountains Recreation and Conservation Authority.  The project spans multiple jurisdictions, including the City of Culver City, City of Los Angeles, and State Parks land. 

 

On July 3, 2018, the Los Angeles County Board of Supervisors awarded a design-build contract to Griffith Company for a contract sum of $6,788,000 and a maximum contract sum of $8,028,000, to construct this new Pedestrian Bridge.  The project is expected to begin design and construction in January 2019 and is slated to be completed by December 2020. 

 

 

DISCUSSION:

 

The County has requested that Culver City and the City of Los Angeles vacate air rights over the respective portions of La Cienega Boulevard, for the purpose of construction of the new pedestrian bridge.

 

The County has agreed to accept air rights 50 feet to the north and 50 feet to the south of the centerline of the proposed bridge, and starting 17 feet about the surface of La Cienega Boulevard, only within the southbound portion of La Cienega Right-of-Way (Culver City portion).

 

On September 24, 2018, the City Council adopted a resolution of intention to vacate the air rights over a portion of La Cienega Boulevard, for the purpose of a new Pedestrian Bridge for the Park to Playa Trail Project, and set the public hearing date of November 12, 2018, pursuant to Chapter 3, Part 3, Division 9 of the Streets and Highways Code.

 

Per the State of California Chapter 3, Part 3, Division 9 of the Streets and Highways Code, notice of the hearing on the proposed vacation was published in the Culver City News on October 25 and November 1, 2018.  Also three signs with the public notice of this meeting were conspicuously posted along La Cienega Boulevard, Wrightcrest Drive, and Lenawee Drive.

 

Also, as required by California Government Code Section 65402, it has been determined that the vacation of the subject alley is in conformity with the Culver City General Plan.  The vacation conforms to the Land Use Element (Page LU-38) of the General Plan:

 

GOAL: A community that provides recreational opportunities.

 

 

FISCAL ANALYSIS

 

The cost to publish the notice of the public hearing for two successive weeks in Culver City News was $1,031.26.  The cost will be paid from account number 10160150.612100, Engineering Services.  Staff stated that the cost would be about $600 in the September 24, 2018, agenda report based on a ¼ page notice.  It was determined later that a ½ page was necessary in order for the map within the notice to be legible.
