RECOMMENDATION

 

Staff recommends the City Council (1) approve a budget amendment to appropriate $50,000 in Parks Facilities (419) Funds for the Culver City Park to
Playa - Ballona Creek Connection ADA Accessible Extension Project, PZ-551
and Culver City Interpretive Nature Trail Repair (budget amendment requires a 4/5ths vote); and, (2) approve a $50,000 increase in the Public Works Director/City Engineer’s change order authority for the Culver City Park to Playa - Ballona Creek Connection ADA Accessible Extension Project, PZ-551 and Culver City Interpretive Nature Trail Repair Project.

 

 

BACKGROUND

 

On November 13, 2017, the City Council awarded a contract to CEM Construction Corporation (1) for a total not-to-exceed amount of $455,037.00 (base bid of $413,670.00 and $41,367.00 in change order authority) for the Culver City Park to Playa - Ballona Creek Connection ADA Accessible Extension Project, PZ-551; and, (2) for a total not-to-exceed amount of $174,482.00 (base bid of $158,620.00 and $15,862.00 in change order authority) for the Culver City Interpretive Nature Trail Repair.  The Ballona Creek Connection (BCC) Project is a capital improvement project funded by the City and a Baldwin Hills Conservancy Proposition 84 Grant.  The Nature Trail Repair is funded in part by the City’s Los Angeles County Proposition A Maintenance and Servicing (M&S) Fund.

 

 

DISCUSSION

 

Although the BCC Project and the Nature Trial Repair have separate funding sources, they were combined as one Project for the purpose of the CEM construction contract.   The change order authority for each component of the CEM contract is tracked separately due to stipulations set forth by the Baldwin Hills Conservancy as terms of the Proposition 84 Grant agreement.  The Project is currently in progress with an anticipated completion date later this year.

 

The Nature Trail (aka the “Boardwalk”) Repair has required additional expenditures that have utilized both the previously City Council approved contingency of $15,862.00 and the City Manager’s maximum $50,000.00 purchasing authority for a single vendor, for this fiscal year.

 

Recently, it was discovered that eight support posts, beams, and joists, at the lower end of the Boardwalk require replacement.  This is an unforeseen condition.  RTI Consulting, Inc., the construction manager, is currently negotiating the change order.  It is estimated that the amount of this change order is in an amount that will not exceed $30,000.  Also the ADA Accessible Extension Project requires additional change order authority of $20,000 due to additional former landfill removal and slurry backfill on the switchback path from the upper ball fields to the lower ball field.  

 

 

FISCAL ANALYSIS

 

Sufficient funds are not available in the City’s Los Angeles County Proposition A M&S Fund for the recently submitted Nature Trail Repair change order proposals.  However, Parks, Recreation and Community Services Department staff has confirmed with the Budget and Finance Department that there are currently sufficient unallocated funds in the Park Facilities (419; “Quimby”) Fund for the proposed budget amendment.  If approved, the funds for the Nature Trail Repair change orders will be transferred to 419.80000.730100.PZ899 (Park Facilities Improvements / Improvements Other Than Buildings).
