RECOMMENDATION

 

Staff recommends the City Council adopt a resolution granting a permit to the Culver City Exchange Club (Exchange Club) to conduct a Beer and Wine Garden in Veterans Memorial Park during the 2018 Fiesta La Ballona.

 

 

BACKGROUND

 

The Culver City Exchange Club is a local non-profit organization that is dedicated to providing financial support to various community-based organizations benefiting children, seniors, and those with disabilities.  The Exchange Club co-sponsors annual events with the City of Culver City, including the Culver City Car Show, the Fourth of July Fireworks Show and the “Kids Carnival” for Children with Disabilities.

 

Culver City Municipal Code (CCMC) Section 13.03.025(A) grants the City Council authority to issue a permit for a beer and wine garden at the City’s Fiesta La Ballona event.  The Beer and Wine Garden (BWG) has been a part of the Fiesta La Ballona (the Fiesta) since 2005.  The Exchange Club has been the permittee for the BWG since 2007.  The Fiesta Beer and Wine Garden Income and Expense Report, with 2018 projections, is provided (Attachment 1).

 

 

DISCUSSION

 

The 2018 Fiesta will be held on Friday, August 24, Saturday, August 25, and, Sunday, August 26.  The Fiesta La Ballona Committee would like to offer a BWG for Fiesta 2018 and is once again recommending the Exchange Club as the BWG vendor.  The Exchange Club desires to sponsor the BWG for Fiesta 2018 and has agreed to comply with all of the conditions imposed in the proposed 2018 resolution (Attachment 2).

 

Revisions to the Proposed Resolution

 

This year, Parks, Recreation and Community Services Department staff has collaborated with Exchange Club members to make the following revisions to the proposed resolution:

 

1.  Per the Exchange Club’s request, the hours of operation have been revised in item 1.b.  The hours are still within the Fiesta’s regularly scheduled hours.

 

Friday - General Fiesta hours are 4:30 PM to 10:00 PM

 

The 2017 Friday BWG hours were 6:30 p.m. to 9:30 p.m., last call was at 9:00 p.m. and no drinks were served past 9:15 p.m.

 

The 2018 proposed hours are 4:30 p.m. to 10:00 p.m., if approved, last call will be at 9:15 p.m. and no drinks will be served past 9:30 p.m.

 

Saturday - General Fiesta hours are 11:00 AM to 10:00 PM

 

The 2017 Saturday BWG hours were 12:00 p.m. to 9:30 p.m., last call was at 8:45 p.m. and no drinks were served past 9:00 p.m.

 

The 2018 proposed BWG hours are 11:00 a.m. to 10:00 p.m., last call will be at 9:15 p.m. and no drinks will be served past 9:30 p.m.

 

Sunday - General Fiesta hours are 11:00 AM to 9:00 PM

 

The 2017 Sunday BWG hours were 12:00 p.m. to 7:00 p.m., last call was at 6:15 p.m. and no drinks were served past 6:30 p.m.

 

The 2018 proposed BWG hours are 11:00 a.m. to 6:30 p.m., last call will be at 5:45 p.m. and no drinks will be served past 6:00 p.m.

 

2.  Item 1.h. was added, as follows:

 

h.                     Permittee’s employees, agents and volunteers who are working the Event (“Event Staff”) shall assist City facilities staff and Culver City Police Department with crowd control in and around the Event Area during any ingress and egress of vehicular traffic adjacent to the Event Area.

 

3.  In item 1.l., language was included to promote compliance with the City’s polystyrene ban.

 

l.                     All alcohol shall be served in recyclable, non-polystyrene cups.

 

4.  In item 1.q., the age requiring a second form of identification was increased from 25 years to 30 years.

 

5.  In item 1.z., clarifying language was added.

 

Insurance and Required Permits

 

Per item 1.d. of the proposed resolution, the insurance requirement for the BWG is one million dollars ($1,000,000) general liability insurance, per occurrence, including liquor liability.  According to the conditions of the proposed Permit, the Exchange Club must submit the required evidence of insurance at least two weeks prior to the Fiesta.  The City Attorney’s Office will review the insurance policy and verify that, in addition to coverage for general liability, the policy includes liquor liability coverage and has added the City of Culver City and the Fiesta Committee as additional insureds.

 

The Exchange Club will have its volunteers trained in applicable laws regarding liquor sales and provide the necessary supervision required to ensure laws are enforced.  Item 1.e. states:

 

e.                     Permittee shall obtain the necessary State of California Alcoholic Beverage Control Board alcohol sales event permit for the Event, which shall be posted at all times.  Permittee shall comply with any and all federal, state and local laws regarding the sale of beer and wine.  Permittee shall also obtain any and all required Los Angeles County health permits, which shall be made available upon request.

 

California State Department of Alcoholic Beverage Control Board Information Sheet ABC-532 outlines recommended guidelines for those who acquire a Special Daily License for the temporary sale of beer or wine (Attachment 3).

 

 

FISCAL ANALYSIS

 

The adoption of the proposed resolution will have a nominal positive fiscal impact to the City due to the collection of the $800 event space fee that will be charged to the Exchange Club for the use of the area within Veterans Memorial Park which the BWG occupies during the Fiesta.  This event space fee will be posted in a revenue account in 10130285 (Fiesta La Ballona).
