RECOMMENDATION

 

Staff recommends the City Council approve (1) an Exchange Agreement and Assignment of Federal Surface Transportation Program Local Funds between Los Angeles County Metropolitan Transportation Authority (“LACMTA”) and the City of Culver City (“City”); and (2) an Agreement to Transfer Funds Acquired by the City from LACMTA to the County Engineers Association of California (CEAC).

 

 

BACKGROUND

 

The League of Cities, the California State Association of Counties (“CSAC”), the County Engineers Association of California (“CEAC”), the Regional Transportation Planning Agencies (“RTPAs”) and the Rural Counties Task Force have teamed together since 2008 to form the Local Streets and Roads Needs Assessment Oversight Committee (“Committee”).  The Committee is responsible for, among other things, oversight of the production of the biennial Local Streets & Roads Needs Assessment Report (“Report”).  This Report has been a vital source of information to the California Legislature in assessing the needs of California’s local roadway network. Charles Herbertson, the Director of Public Works/City Engineer for Culver City has been representing the League of Cities on this Committee since 2010 and became Chairman for the Committee and Project Manager for the report in January 2015.  He will continue in this capacity until January 2019.

The Report is funded by all of the participating partners with counties funding 25%, the cities funding 25% and the regional transportation planning agencies funding the remaining 50%.  Counties collect the money for the report with their annual dues and transfer the money to an account with CEAC that is set up for the purpose of paying the costs associated with producing the REPORT.  Cities collect the funds for the Report by invoicing League member cities on a biennial basis and transferring the money to CEAC.  The RTPAs from around the state either send money directly to CEAC or have the money taken out of their Federal Surface Transportation Program Local (“STP-L”) funds by California Department of Transportation (“CALTRANS”).  By previous arrangement these funds are transferred by CALTRANS to the LACMTA where they are exchanged for local funds and then transferred to CEAC.  (The STP-L funds cannot be transferred to a non-public agency.  (CEAC is a non-profit agency formed to represent County interests at the State level in similar fashion to the League of California Cities.)

In the past Los Angeles County Department of Public Works conducted an exchange of local funds for STP-L funds with LACMTA.  However, in this current cycle, Los Angeles County is unable to conduct this fund exchange due to insufficient local funds.

 

 

DISCUSSION

 

Staff worked with LACMTA staff to develop an alternative approach to transfer the STP-L contributions from the RTPAs to CEAC.  Firstly, LACMTA will credit Culver City with the STP-L contributions from the RTPAs.  Secondly, LACMTA and Culver City will conduct an exchange of the STP-L funds newly credited to Culver City for LACMTA local funds which can be legally transferred to CEAC.  Thirdly, Culver City will enter into an agreement to transfer the local funds to CEAC.  These local funds will then be used to fund the 2018 study.

 

 

FISCAL ANALYSIS

 

The exchange of funds will not have a fiscal impact on Culver City.

MOTION

 

That the City Council:

 

1.                      Approve an Exchange Agreement and Assignment of Federal Surface Transportation Program - Local Funds between the City of Culver City and Los Angeles Metropolitan Transportation Authority; and

 

2.                     Approve an Agreement to Transfer Funds Acquired By The City from LACMTA to the County Engineers Association of California (CEAC); and

 

3.                     Authorize the City Attorney to review/prepare the necessary documents; and

 

4.                     Authorize the City Manager to execute such documents on behalf of the City.
