RECOMMENDATION
Staff recommends the City Council approve a professional services agreement with California Watershed Engineering for the design of Washington Boulevard Regional Project, PR-001 in an amount not-to-exceed $413,600 ($376,000 base cost with a 10% contingency of $37,600).
BACKGROUND/DISCUSSION
On December 28, 2012, the Los Angeles Regional Water Quality Control Board
(LARWQCB) adopted R4-2012-0175, a National Pollutant Discharge Elimination
System (NPDES) Municipal Separate Storm Sewer System Permit (MS4 Permit). This latest MS4 Permit establishes waste discharge requirements for stormwater and non-stormwater (urban runoff) discharges within the watersheds of Los Angeles County.
The Marina del Rey (MdR) watershed is a small sub-watershed located in the larger,
Santa Monica Bay watershed. The tributary area served by the MS4 Permit that drains to MdR harbor is approximately 1,409 acres and consists of portions of the cities of Culver City and Los Angeles and unincorporated County of Los Angeles (County). The MdR watershed is subject to three Total Maximum Daily Loads (TMDLs); the Santa Monica Bay Nearshore Debris TMDL, the Marina del Rey Harbor Mother’s Beach and Back Basin Bacteria TMDL, and the Toxic Pollutants in Marina del Rey Harbor TMDL. The interim and final compliance schedules differ for each of the TMDLs, but final compliance is required by 2018 and 2021.
To comply with the MS4 Permit, the City Council approved the development and implementation of an Enhanced Watershed Management Program (EWMP). The
EWMP reviews the watershed as a whole and proposes Best Management Practices (BMPs) for responsible jurisdictions to complete. Furthermore, construction of larger regional projects that could capture, infiltrate, and/or reuse storm flows and urban runoff from an 85th percentile storm event or roughly 1.1 inch of rain is also required.
Costco Public Private Partnership
In January 2015, staff began discussions with Costco to develop a joint stormwater/urban runoff retention project as part of their redevelopment project. Costco plans to redevelop over 50% of their property and must implement a Standard Urban Stormwater Mitigation Plan (SUSMP). The SUSMP must include a treatment BMP that can capture and infiltrate the 85th percentile storm from their entire property, not just the redeveloped area. Since the Costco site along Washington Boulevard is situated in Culver City’s portion of the MdR watershed, staff identified this project as an opportunity to capture stormwater/urban runoff flows from both Costco and neighboring businesses and residences. Thus, Culver City’s entire portion of the MdR watershed could potentially be served by this proposed Public Private Partnership Project.
DISCUSSION:
The Public Works Department’s Environmental Programs and Operations Division (PW-EPO) is proposing a Diversion System Project (Project) to capture stormwater/urban runoff from approximately 65 acres of drainage area (including Costco). This drainage area is primarily commercial and residential. The City proposes to capture, treat, and retain the 85th percentile, 24-hour storm event into large storage chambers under Washington Boulevard. After 72 hours of a rain event, the captured volume will then be pumped back into the downstream existing storm drains which diverts into an existing County of Los Angeles’ Low Flow Diversion (LFD) System at Washington Boulevard and Thatcher Avenue. The existing LFD currently discharges into an existing sanitary sewer system conveying runoff to the City of Los Angeles’ Hyperion Sewer Treatment Plant for treatment of dry weather runoff flows. The City is also proposing to construct bio-filtration systems along the Washington Boulevard to pick up irrigation run-off from the localize areas.
In December 2016, staff received eight (8) proposals for the civil design of the Project. After careful review of the proposals and interviewing the top three firms, staff chose the most qualified firm, California Watershed Engineering (CWE). CWE have planned and designed more regional BMP projects than any other firm in Southern California, and is widely recognized as an industry leader in the design of multi-benefit BMP and urban runoff diversion projects. CWE’s multi-benefit enhancement projects have been recognized with 18 awards in the past five years. Their commitment to high-quality work means that the City can expect CWE to deliver an exceptional, innovative project, which will bring the City due recognition for its efforts to enhance water quality and conserve water. CWE also provided the lowest proposal at $376,000.
In February 2016, the City executed a grant agreement with the Los Angeles County Regional Park and Open Space District for an amount of $767,136.
In January 2017, the City executed a cost-sharing agreement with Costco for their fair share in the amount of $1,405,000 for the Project. Costco will be billed three separate times: upon City Council’s approval of (1) professional services agreement for design services, (2) award of construction contract agreement for construction, and (3) award of construction contract agreement for construction management.

The cost for final design services as stated in CWE’s proposal is $376,000. It is recommended that the City Council authorize the Public Works Director/City Engineer to authorize amendments to the agreement for additional design work in an amount not-to-exceed $37,600 (10%) if necessary.
MOTION
That the City Council:
1. Approve a professional design services agreement with California Watershed Engineering for the design of the Washington Boulevard Regional Project, PR-001 in an amount not-to-exceed $376,000;
2. Authorize the Public Works Director/City Engineer to approve amendments to the agreement with California Watershed Engineering in an amount not-to-exceed $37,600 for additional design work;
3. Authorize the City Attorney to review/prepare the necessary documents; and
4. Authorize the City Manager to execute such documents on behalf of the City.
