RECOMMENDATION:
Staff recommends the City Council adopt an ordinance amending Sections
3.05.015.D and 3.05.015.F of the Culver City Municipal Code relating to exemptions
to the classified service.
BACKGROUND/DISCUSSION:
At the City Council meeting of July 8, 2013, the City Council introduced the
ordinance by a unanimous vote (5-0). Tonight, the ordinance is brought back for
adoption.
FISCAL ANALYSIS:
Adoption of the proposed Ordinance does not create a fiscal impact to the City.

WHEREAS, at its meeting of February 6, 2013, the Civil Service Commission
adopted a motion recommending to the City Council that Culver City Municipal Code
(CCMC) Sections 3.05.015.D and 3.05.015.F be amended to clarify that all Department
Heads, Assistant and Deputy Department Heads, Division Heads, and management
positions that report directly to a department or division head shall be exempt from the Civil
Service System; and
WHEREAS, this clarification is consistent with the City's past custom and
practice; and
WHEREAS, in accordance with the City Charter, this exemption shall only be
applied prospectively and shall not affect the Civil Service status of any current employee,
position or job classification.
NOW THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY ORDAIN as follows:
SECTION 1. Section 3.05.015.D is hereby amended to read as follows
(deletions indicated by strike throughtext; additions indicated by underlined text):
"D. Department Heads, Assistant and Deputy Department Heads, and

3 SECTION 3. Pursuant to Section 619 of the City Charter, this Ordinance
4 shall take effect thirty (30) days after the date of its adoption. Pursuant to Sections 616
5 and 621 of the City Charter, prior to the expiration of fifteen (15) days after the adoption,
6 the City Clerk shall cause this Ordinance, or a summary thereof, to be published in the
7 Culver City News and shall post this Ordinance or a summary thereof in at least three
8 places within the City.
9 SECTION 4. The City Council hereby declares that, if any provision, section,
10 subsection, paragraph, sentence, phrase or word of this ordinance is rendered or declared
11 invalid or unconstitutional by any final action in a court of competent jurisdiction or by
12 reason of any preemptive legislation, then the City Council would have independently
13 adopted the remaining provisions, sections, subsections, paragraphs, sentences, phrases
14 or words of this ordinance and as such they shall remain in full force and effect.
