RECOMMENDATION:
Staff recommends the City Council:
(1) Accept the work performed by the contractor, FS Construction and
authorize filing a Notice of Completion for the City’s Annual Curb, Gutter,
and Sidewalk Replacement Project, P-428, and Community Development
Block Grant (CDBG) Curb, Gutter, and Sidewalk Replacement Project, P-
886; and,
(2) Authorize the Public Works Director/City Engineer to file the Notices of
Completion for these projects; and,
(3) Authorize the release of retained funds in the amount of $14,273.41 and
$5,195.90 (respectively for each project) to the contractor after the thirty-
five day lien period expires.
BACKGROUND/DISCUSSION:
On October 10, 2007, the City Council awarded a construction contract to
FS Construction for the replacement of uplifted, damaged and deteriorated
sidewalks, drive approaches, and curb and gutter along selected streets for the
Curb, Gutter, and Sidewalk Replacement Project, P-428, and CDBG Curb, Gutter,
and Sidewalk Replacement Project, P-886. These projects were combined in order
to obtain a more competitive bid and to gain benefit from economies of scale.
Also the City Council authorized staff to negotiate additional work not exceeding the
total combined project budget of $197,773.00, due to the favorable low bid received.

FS Construction successfully completed the replacement of the sidewalks, curb and
gutter, and drive approaches on both projects as required per the original contract
on time and under budget. The original contract amount was $99,494.75 and
$21,296, for Projects P-428 and P-886, respectively (for a total of $120,790.75).
There were three (3) change orders issued in the total amount of $73,902.38 for
additional replacement of curb, gutter, sidewalk, and driveway approaches that were
added to the project as authorized by the City Council. The final combined
construction cost was $194,693.13 and below the overall budget of $197,773.00.
FISCAL ANALYSIS:
Adequate Gas Tax and CDBG Grant funding were appropriated for the contract and
change orders within the Capital Improvement Program Budget in the Curb, Gutter,
and Sidewalk Replacement Project, P-428 (Business Unit 41800428) and
Community Development Block Grant (CDBG) Curb, Gutter, and Sidewalk
Replacement Project, P-886 (Business Unit 42800886), in Fiscal Year 2007/08.

Gutter, and Sidewalk Replacement Project, P-428, and Community Development
Block Grant (CDBG) Curb, Gutter, and Sidewalk Replacement Project, P-886;
2) Authorize the Public Works Director/City Engineer to execute and file the Notices
of Completion with the Los Angeles County Recorder’s Office;
4) Authorize the release of $14,273.41 and $5,195.90 to FS Construction for the
Curb, Gutter, and Sidewalk Replacement Project, P-428, and Community
Development Block Grant (CDBG) Curb, Gutter, and Sidewalk Replacement
Project, P-886, respectively, following expiration of the 35-day lien period.
