RECOMMENDATION
Staff recommends the City Council discuss and provide direction regarding whether to adopt a position on AB 1537 (Bryan), and, if desired, authorize the Mayor to transmit a letter reflecting the City Council's position to the California State Legislature.
BACKGROUND/DISCUSSION
At the January 26, 2026 City Council Meeting, Vice Mayor Fish discussed the active legislative platform and received consensus from Mayor Puza and Council Member McMorrin to consider Assembly Bill (AB) 1537 from Assemblymember Isaac Byran to prevent police officers from having secondary employment with ICE.
AB 1537 (attached) was introduced during the 2025-2026 California Legislative Session.
Existing law:
1. Provides that every executive or ministerial officer, employee, or appointee of the State of California, or any county or city therein, or any political subdivision thereof, who knowingly asks, receives, or agrees to receive any emolument, gratuity, or reward, or any promise thereof excepting such as may be authorized by law for doing an official act, is guilty of a misdemeanor.
2. Exempts from that offense certain employment by a peace officer while off duty, as specified.
