RECOMMENDATION:
Staff recommends the City Council conduct a Public Hearing and introduce an
ordinance adopting by reference the 2007 California Building Standards
Administrative Code, Building Code, Electrical Code, Plumbing Code, Energy
Code, Elevator Safety Construction Code, Historical Building Code, Code for
Building Conservation, and Reference Standards Code.
PROCEDURE:
1. Mayor seeks a motion to receive and file the affidavit for publishing a legal
notice.
2. Mayor requests a brief staff report and City Council poses questions to staff as
desired.
3. Mayor opens public hearing and invites public comments.
4. Mayor seeks a motion to close the public hearing.
5. Based on public comment and staff research, City Council discusses the
proposed recommendation and arrives at its decision.

BACKGROUND/DISCUSSION:
The California Building Standards Commission in 2007 adopted the Triennial
Editions of the California Code of Regulations, Title 24, consisting of the 2007
California Building Standards Administrative Code, 2007 Building Code, 2007
Electrical Code, 2007 Plumbing Code, 2007 Energy Code, 2007 Elevator
Safety Construction Code, 2007 Historical Building Code, 2007 Code for
Building Conservation, and 2007 Reference Standards Code, as well as other
regulations. All jurisdictions in California are required to adopt the California
Codes based on the California Code of Regulations, Title 24.
The 2007 California Codes are based on the 2006 International Codes,
developed by the International Code Council (“ICC”), which combined the major
model code groups into one council with the intent to create one universal code
for the entire United States.
The former 2001 California Codes were based on the 1997 Uniform Building
Codes (UBC) promulgated by the former International Conference of Building
Officials (ICBO). The former UBC Codes and the former ICBO no longer exist;
the former UBC Codes are replaced by the current International Codes and the
former ICBO is now part of the current International Code Council (ICC).
The 2007 California Building Codes went into effect statewide January 1st, 2007
and are in effect in all jurisdictions in California as of that date whether adopted
by local jurisdictions or not. Local jurisdictions may adopt amended versions of
the California Codes but only if such amendments are stricter than the base
California Codes and such amendments are subsequently approved by the
California Building Standards Commission.
Staff is currently considering an amendment to the 2007 California Building
Code regarding existing non-conforming assembly occupancy classifications,
which will be brought for City Council review in the future.
FISCAL ANALYSIS:
There is no fiscal impact associated with adopting the updated Building Code
regulations.
