RECOMMENDATION

Staff recommends the City Council adopt a resolution ordering the vacation of 543 square feet of the portion of Drakewood Avenue fronting 10701 Ranch Road, Tract No. 18215, pursuant to Division 9, Part 3 Chapter 3 of the Streets and Highway Code (Attachment 1).


PROCEDURE
1. Mayor seeks a motion from the City Council to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and,
2. Mayor calls for a staff report, and the City Council Members may pose questions to staff as desired; and,
3. Mayor seeks a motion to open the public hearing; and,
4. Mayor seeks a motion to close the public hearing after all public testimony has been presented; and,
5. The City Council discusses the item and arrives at its decision.


BACKGROUND/DISCUSSION

The homeowners of 10701 Ranch Road petitioned the City to vacate a sliver of public right-of-way (543 square feet) in order for it to align with the existing long-term improvements, mainly fencing, behind the back of the curb. A records search determined that the aforementioned property owners own the underlying fee to this portion of Drakewood Avenue.
