RECOMMENDATION:
Staff recommends the City Council approve the Revised Classification Specification
for Jailer.
BACKGROUND:
For over 30 years, the Jailer classification has been required to carry a firearm. This
City practice is in direct violation with Penal Code 831 which states that, “A custodial
officer shall have no right to carry or possess firearms in the performance of his or
her prescribed duties.”
Upon receipt of this information the Chief of Police removed the firearms and offered
the opportunity to meet and confer with the bargaining unit over the impact of this
decision.
In light of the decision by the City and Chief of Police and subsequent agreement
with the bargaining unit, the revised classification specification (Attachment 1) is
being brought for approval.
DISCUSSION:
The revised classification specification reflects the removal of the firearm.
Specifically, this is noted in the “Essential Job Duties” and “Minimum Knowledge
Skill and Ability” sections of the classification. The new language captures the

current practice of the City, which requires proficient use of authorized non-lethal
weapons.
In addition, the class spec has been reviewed by Personnel and Police Department
Management staff resulting in minor revisions that update language to clarify duties
as well as when the required licenses and/or certificates must be obtained.
On September 5, 2007, the Civil Service Commission approved the revised
classification specification for Jailer.
FISCAL ANALYSIS:
There is no fiscal impact associated with the approval of the revised classification
specification for Jailer.
