Baker) (09/26/12) City Manager Approval: John Nachbar (09/26/12) RECOMMENDATION: It is recommended that the City Council consider the creation of a Citizens Committee on Fracking and direct the City Manager as deemed appropriate. BACKGROUND: At the City Council meeting of July 23 2012 the City Council directed the City Manager to place on a future agenda a discussion on whether the City Council wanted to create a citizens committee on fracking. DISCUSSION: As the City Council considers this subject it may be helpful to recall the requirements of the Ralph M. Brown Act (Brown Act). Section 54952(b) of the Brown Act provides: As used in this chapter legislative body means: A commission committee board or other body of a local agency whether permanent or temporary decision making or advisory created by charter ordinance resolution or formal action of a legislative body.
