RECOMMENDATION:

Staff recommends the City Council adopt a resolution certifying and reciting the fact of the General Municipal Election held on November 8, 2022 and stating the results of such Election.


BACKGROUND/DISCUSSION:

Section 1500 of the City Charter states, in pertinent part:

"General municipal elections for the filling of all elective offices, other than the Board of Education, shall be held in the City on the date of the statewide general election."

Section 1503 of the City Charter states:

"Unless otherwise provided by this Charter, all City elections shall be held in accordance with applicable provisions of the then current State law."

Elections Code Sections 10263(b) and 10264 provide, in pertinent part:

10263. Upon the completion of the canvass and before installing the new officers, the governing body shall adopt a resolution certifying and reciting the fact of the election and the other matters that are enumerated in Section 10264. The governing body shall declare elected the persons for whom the highest number of votes was cast for each office.
