City of Culver City, California City Council Agenda Item Report RECOMMENDATION: Staff recommends that the City Council adopt an Ordinance (Attachment 1) amending various provisions of §§ 9.10.055 and 9.10.200 of the Culver City Municipal Code relating to park regulations for the purpose of mitigating nuisance activity and clarifying existing regulations. BACKGROUND/DISCUSSION: At the City Council meeting of December 12, 2005, the Council introduced the Ordinance by a unanimous vote (5-0). The Ordinance is brought back tonight for adoption. AND 9 10 200 OF THE CULVER CITY MUNICIPAL CODE RELATING TO PARK REGULATIONS, FOR THE PURPOSE OF MITIGATING NUISANCE ACTIVITY AND CLARIFYING EXISTING REGULATIONS WHEREAS over the past several years, as the number of people using the City s parks has grown, clarification and enforcement of park regulations have become increasingly important to the community's use and enjoyment of the parks, and WHEREAS, park-related issues have arisen concerning nuisance activity occurring in the City s parks including, but not limited to interference with park maintenance staff, vandalism, littering, abandoned property and persons using the park when it is closed, and WHEREAS, on July 26, 2004, the City Council took a number of actions pertaining to these issues, including directing staff to review various provisions of the City's Municipal Code to determine whether certain sections should be amended in order to improve enforceability of park regulations, address nuisance activity, and better secure the City s parks NOW THEREFORE, the City Council of the City of Culver City, California, DOES HEREBY ORDAIN as follows SECTION 1 Section 9 10 055 (C) of the Culver City Municipal Code is hereby amended to read as follows C To swim, bathe, wade in or pollute the water of any fountain or pond I 1SECTION 2 Section 9 10 055 (D) of the Culver City Municipal Code is hereby amended to read as follows D To make kindle or use a fire, barbecue, portable stove or burning charcoal except in designated areas provided by the City for such purpose or in such areas and under such regulations as may be designated by the Parks, Recreation and Community Services Director No person shall drop, throw or otherwise scatter lighted matches burning cigarettes or cigars, tobacco paper or other flammable material, within any park area or upon any public property, highway, road or street abutting or contiguous thereto SECTION 3 Section 9 10 055 (E) of the Culver City Municipal Code is hereby amended to read as follows E To camp occupy camp facilities or use camp paraphernalia, provided however, that the Parks, Recreation and Community Services Director may issue a temporary permit to allow camping in connection with a special event No person shall store personal property, including camp facilities and camp paraphernalia, within any public park or upon any public property For purposes of this subsection, the following definitions shall apply|109| Camp means to pitch or occupy camp facilities or to use camp paraphernalia,|109| Camp facilities include, but are not limited to, tents, huts or temporary shelters|109| Camp paraphernalia includes, but is not limited to, tarpaulins, cots beds, sleeping bags hammocks cooking facilities and similar|101010101010101010|R|10 10 10|11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 1428equipment Camp paraphernalia shall not include City-designated cooking facilities or equipment|109| Store means to put aside or accumulate for use when needed, to put for safekeeping, or to place or leave in a location SECTION 4 Section 9 10 055 (H) of the Culver City Municipal Code is hereby amended to read as follows H To sleep or lay on tables seats, benches, playground equipment or any other areas not intended for such use or purpose SECTION 5 Section 9 10 055 (N) of the Culver City Municipal Code is hereby amended to read as follows N To deposit any paper, food, rubbish, debris, or any waste material of any kind, except in City-designated receptacles SECTION 6 Section 9 10 055 (0) of the Culver City Municipal Code is 15 hereby repealed and replaced with the following new Section 9 10 055 (0) 16 17 0 To fight or challenge another person to fight maliciously or 18 willfully disturb another person by loud and unreasonable noise or use offensive 19 words which are inherently likely to provoke an immediate violent reaction from 20 another person 21 SECTION 7 Section 9 10 055 (P) of the Culver City Municipal Code is 22 hereby repealed and replaced with the following new Section 9 10 055 (P) 23 P To interfere with or hinder any employee, agent or volunteer of 24 the City engaged in maintenance or repair of any park or park facility 25 SECTION 8 Section 9 10 055 (Q) of the Culver City Municipal Code is 26 hereby amended to read as follows|1010| 3|1010101010101010|R|10 10 10|11 12 13 14 27 28Q To enter, use or abet the use of any area in violation of posted notices SECTION 9 Section 9 10 055 (S) of the Culver City Municipal Code is hereby amended to read as follows S To maliciously, willfully or unreasonably disturb or interfere with any person or party occupying any area, or participating in any activity, under the authority of a permit SECTION 10 Section 9 10 055 (T) of the Culver City Municipal Code is hereby added as follows T To enter any park park area or park facility which is barricaded or fenced for maintenance, repair or construction, without the authorization of the Parks, Recreation and Community Services Director SECTION 11 Section 9 10 200 (D) of the Culver City Municipal Code is hereby amended to read as follows D Deposit any paper, food, rubbish, debris or any waste material of any kind in any public restroom, except in City-designated receptacles No person over the age of ten years shall use the restrooms and washrooms designated for the opposite sex SECTION 12 Pursuant to Section 512 of the City Charter this Ordinance shall take effect thirty (30) days after the date of its adoption Pursuant to Sections 514 and 517 of the City Charter prior to the expiration of fifteen (15) days after the adoption, the City Clerk shall cause this Ordinance, or a summary thereof, to be published in the Culver City News and shall post this Ordinance or a any provision section, subsection, paragraph, sentence, phrase or word of this ordinance is rendered or declared invalid or unconstitutional by any final action in a court of competent jurisdiction or by reason of any preemptive legislation, then the City Council would have independently adopted the remaining provisions sections, subsections paragraphs, sentences, phrases or words of this ordinance
