Kimball) (03/30/10) City Manager Approval: Mark Scott (04/01/10) RECOMMENDATION: Staff recommends that the City Council (1) accept the work performed by Hardy and Harper, Inc., (2) authorize the filing a Notice of Completion, and (3) authorize the release of retention funds in the amount of $15,479 after the thirty-five day lien period has expired for the Culver Boulevard Resurfacing Project, P-911. BACKGROUND/DISCUSSION: On September 21, 2009, the City Council awarded a construction contract to Hardy and Harper, Inc. The project consisted of grinding 3 inches of existing asphalt concrete (AC) pavement and replacing it with 1 inch of new conventional asphalt and 2 inches of new rubberized asphalt concrete hot-mix pavement on Culver Boulevard between Commonwealth Avenue and Elenda Street. Also the scope of work included removing and replacing 4 curb ramps, re-striping of pavement markings with thermoplastic paint, and the installation of raised pavement markers. Hardy and Harper, Inc. successfully completed the work as required in the executed contract dated October 21, 2009. There is a one year warranty on the work product for any potential defects. The construction management was performed by staff, and construction inspection was performed by APD Consultants through the on-call general civil engineering contract. Construction geotechnical service was performed by Zeiser-Kling, Inc., through the on-call general geotechnical engineering contract. City of Culver City, California Agenda Item Report FISCAL ANALYSIS: The approved construction contract amount was $211,000. The final construction expenditure amount was $154,789. There were cost savings realized on pavement reconstruction. Project Budget Funding Source Amount American Recovery and Reinvestment Act (ARRA) Funds (Fund 423) (Federal Stimulus Funds) $283,000 Total $283,000 Final Project Expenses Construction of Residential Overlay Project, P-911 $154,789 Construction Inspection Services $9,090 Geotechnical Construction Services (Observation & Testing) $9,105 Total $172,984 The original ARRA grant award for this project was $400,000 and the total contract award was $283,000. Due to cost savings, the remaining ARRA grant balance is $227,016 (i.e. $400,000 award less $172,984 actual cost). Staff has been working with the Metropolitan Transportation Authority and California Department of Transportation to re-allocate the unspent ARRA (Federal Stimulus) funds toward the Ballona Creek Bikeway and Landscaping Project or other eligible ARRA projects. MOTION: That the City Council: 1) Accept the work performed by the contractor, Hardy and Harper, Inc. for the work performed on the Culver Boulevard Resurfacing Project, P-911 (Federal Aid Project No. ESPL 5240(024)); and, 2) Authorize the City Manager to execute the Notice of Completion and submit it to the Los Angeles County Recorder’s office for recordation; and, 3) Authorize the release of $15,479 in retention funds to Hardy and Harper, Inc. following the expiration of the thirty-five day lien period.
