RECOMMENDATION
Staff will present a report regarding the enforcement mechanisms available to the City to promote compliance by Bird, the City’s shared micromobility vendor, within the terms of its operating agreement with the City. Members may discuss and provide staff with input and direction.
BACKGROUND/DISCUSSION
At its May 26, 2026 General Meeting, the City Council approved the Fiscal Year 2026-27 (FY27) operating agreement with Bird for the City’s shared micromobility program and directed staff to return to the Mobility Subcommittee with additional detail on the agreement’s provisions and on the enforcement methods available to ensure rider safety and vendor compliance.
Staff will present an overview of the program, including current service limits, ridership and complaint trends, and the program’s fiscal position. Staff will then review the enforcement tools available under the current agreement - ranging from complaint-driven response and remote compliance monitoring, to user-responsibility provisions, to agreement-level escalation - together with the practical trade-offs of each. Staff will also seek the Subcommittee’s input on considerations to weigh for future iterations of the agreement, which will require competitive procurement for FY28.
Members may discuss and provide staff with input and direction on: (1) the City’s enforcement posture under the upcoming one-year FY27 agreement and (2) considerations to study and account for in future program procurements and contracts.
