Schultz Construction; (2) authorize the filing of a Notice of Completion; and (3) authorize the release of the retention payment for the Syd Kronenthal Park Playground Rehabilitation Project, PZ831, in the amount of $8,662 after the expiration of the 35- day lien period. BACKGROUND/DISCUSSION: In 2013 the Los Angeles County Board of Supervisors approved Proposition A Cities Excess Funds in the amount of $250,000.00 for the Syd Kronenthal Park Playground Rehabilitation Project, PZ831. On October 13, 2014 the City Council approved the final plans and specifications and authorized the publication of a Notice Inviting Bids for the Project. On January 12, 2015, the City Council awarded a contract to R.E. Shultz Construction Services, as the lowest responsive and responsible bidder, in an amount not-to-exceed $207,888 ($173,240 base bid plus $34,648 in change order authority) for construction of the Project. The scope of work for the Project included: (a) replacing the outdated playground equipment with sculptural elements that are both physically and mentally challenging; (b) replacing the sand surfacing with 100% engineered wood fibar; (c) City of Culver City, California Agenda Item Report incorporating needed features such as an accessible ramp; and, (d) providing a path of travel to and from the parking area to the playground area that will bring the entire playground into 100% Federal ADA compliance. The construction was completed on April 29, 2015 and a grand re-opening of the playground area was held on April 30, 2015. FISCAL ANALYSIS: The Syd Kronenthal Park Playground Rehabilitation Project, PZ831, is fully-funded by Proposition A Cities Excess Funds. There were no change orders for the Project, and the total R. E. Shultz Construction contract amount is $173,240 ($164,578 have been expended to-date, leaving a retention payment of $8,662). There are sufficient funds available for the retention payment in the City Council Adopted Budget for Fiscal Year 2014/2015 in account 42380000.730100.PZ831 (Grants Capital Projects/Improvements Other Than Buildings / Syd Kronenthal Playground Project). Other expenditures for this Project include approximately $10,000 in Project Management fees (contracted); $3,566 for the California Conservation Corps’ installation of the wood fibar as per the City Council adopted Youth Employment Plan for the Project; $1,422 for the Playground Inspection by Playground Safety Analysts, and approximately $160 in filing fees. This leaves an unexpended grant amount of approximately $60,000 which staff intends to use for additional eligible playground/park-related amenities at the Syd Kronenthal Park Playground, pending approval from the Los Angeles County Regional Park and Open Space District. MOTIONS: That the City Council: 1. Accept the work performed by R. E. Schultz Construction for the Syd Kronenthal Park Playground Rehabilitation Project, PZ831; and, 2. Authorize the Parks Division Manager to execute the Notice of Completion and submit it to the Los Angeles County Recorder’s Office; and, 3. Authorize the release of $8,662.00 in retention funds to R. E. Schultz Construction after the expiration of the 35-day lien period.
