Nachbar (05/06/15) RECOMMENDATION: Staff recommends the City Council adopt a resolution recognizing and confirming that personnel of the Culver City Fire Department are compensated on a portal to portal basis when assigned to emergency incidents in the jurisdiction of another fire agency. BACKGROUND: In the 1970s, the State of California was hit hard by a number of devastating wildfires. Recognizing the need for sharing resources throughout the state during a large scale emergency, the state developed a program for organizing and sharing resources during a disaster. Culver City has been participating in this program (California Master Mutual Aid Agreement) since its inception. This has been a model program emulated throughout the country. Through this program, resources are shared not only throughout the state, but at times, personnel may be requested to respond throughout the United States. The agencies providing resources are reimbursed for the costs incurred of providing the resources including overtime and wear and tear on apparatus and equipment. DISCUSSION: On January 1, 2015, the State adopted a new California Fire Assistance Agreement (CFAA) which requires certain documentation for the City to continue to be fully City of Culver City, California Agenda Item Report reimbursed. The proposed resolution, if adopted by the City Council, will satisfy the State’s requirements. Prior to the adoption of the new CFAA, Culver City was reimbursed for the full cost of providing firefighters to another jurisdiction including the time travelling to the incident, all time at the incident, including rest periods, and the time travelling back to Culver City from the incident. For reimbursement purposes, this was termed portal-to-portal. The new CFAA requires documentation that the City pays its employees portal-to-portal to receive the full reimbursement for all time spent at the incident. The proposed resolution does not change any terms or conditions of existing MOUs and acknowledges the past practice of paying employees for the entire time they are away from the City and providing services to another jurisdiction. FISCAL ANALYSIS: Without proper documentation for the State’s CFAA, there would be significant loss of Strike Team reimbursement revenue.
