RECOMMENDATION:
Staff recommends the City Council approve the submission of a grant application
for the construction of a low flow diversion system at the end of Le Bourget
Avenue near a City owned outfall into Ballona Creek (Creek) through the
Proposition 84 Stormwater Grant Program.
BACKGROUND/DISCUSSION:
Proposition 84 Stormwater Grant Program
California voters passed Proposition 84 on November 7, 2006. Proposition 84
allocated approximately $90 million to create a Stormwater Grant Program to
fund the planning and implementation of projects to prevent stormwater
contamination of the State’s rivers, lakes and streams. Approximately $42 million
of this total are available under a solicitation released in late 2011 and due
January 31, 2012.|1010|
Ballona Creek and Total Maximum Daily Loads (TMDL)
Ballona Creek is currently listed on the State's 303(d) list as impaired due to
exceedances of total metals, toxics, trash, and bacteria. Dry weather runoff from
|1010| Up to $10 million total from Round 1 and Round 2 may be used for storm water related Total
Maximum Daily Loads. The remainder of the funds will go towards Low Impact Development
Projects. January 31, 2012 is the deadline for concept proposals. There will be a second deadline
for projects that are selected to submit full proposals.

sources such as irrigation and residential car washing represents a significant
source of these contaminants.
The City has already taken a number of actions to improve water quality in
Ballona Creek in compliance with the TMDLs, such as: Weekly (daily in
downtown) street sweepings, installation of Continuous Deflective Separation
units, and catch basin trash screens (installation in progress). In addition,
multiple rain gardens are also in progress and will help reduce the levels of
metals, toxics, and bacteria.
Dry Weather (Low Flow) Diversion
Dry weather runoff is water that enters the storm drain system during non-rain
events. Sources of dry weather runoff include residential car washing, irrigation
over spray, driveway and sidewalk washing, non-chlorinated swimming pool
water discharge, flushing of potable water system, etc. A dry weather diversion
system can greatly reduce the amount of contaminants reaching the Ballona
Creek and the Pacific Ocean by diverting dry weather runoff to the sanitary sewer
system. Los Angeles County (County) and Los Angeles City (LA) have
successfully implemented a similar system in Marina del Rey that treats up to
64,800 gallons per day of dry weather runoff.
Proposed Project
Staff is seeking City Council approval to apply for a Proposition 84 Stormwater
Grant in order to construct a dry weather diversion project at the end of Le
Bourget Avenue near a City owned storm drain outfall in Ballona Creek. This
location has been selected because large dry weather flow from 20 catch basins
could be easily redirected to the nearby Jasmine Sewer Pump Station|1010|. By
diverting this flow during non-rain events, the project is anticipated to reduce the
oil, metals, and other contaminants that may enter Ballona Creek during this time
period and help the City meet its dry weather TMDL’s.
The Amalgamated Sewer Agreement with LA allows the City to divert up to
165,000 gallons per day of dry weather flow to the Hyperion Treatment Plant.
This proposed project would divert approximately 1,000 gallons per dry day and
up to the maximum amount allowed for all diversions under the Amalgamated
Sewer Agreement during initial rain events.

This evening, staff is seeking the City Council’s approval to submit the grant
application. Should the City Council so approve and if the grant is awarded to
the City, then staff will return to the City Council with a request for the City
Council to accept the grant and also designate the required matching funds.
FISCAL ANALYSIS:
There is a 20 percent matching requirement for this grant. The project is
anticipated to cost approximately $700,000. Thus, if the grant is approved, about
$140,000 in matching funds are anticipated to be required. If the City’s grant
application is approved, staff anticipates returning to the City Council either
separately or as part of the budget process to request funding for the match.
Staff will investigate the potential use of Sewer or other restricted funds for the
match, with the General Fund being the last option.
MOTIONS:
That the City Council
1. Approve the submission of a grant application through the Proposition 84
Stormwater Grant Program; and,
2. AAuthorize the City Attorney to review/prepare the necessary documents;
and,
3. Authorize the City Manager to execute such documents on behalf of the
City.
