WHEREAS, a General Municipal Election was held and conducted in the City of Culver City, California, on Tuesday, April 13, 2010, as required by the Charter of the City of Culver City; and, WHEREAS, notice of the election was duly and regularly given in the time, form, and manner as provided by law; voting precincts were properly established; election officers were appointed; and, in all respects, the election was held and conducted, the votes were cast, received and canvassed, and the returns were made and declared in the time, form and manner, as required by the provisions of the Charter of the City of Culver City; and, WHEREAS, the City Clerk, acting in the capacity of Elections Official as provided for in the Charter of the City of Culver City, canvassed the returns of the election and has certified the results to this City Council, which results are received, attached, and made a part hereof as Exhibits "A" and "B." NOW, THEREFORE, the City Council of the City of Culver City, California, DOES HEREBY RESOLVE as follows: 1. The whole number of ballots cast in the precincts except vote by mail ballot and provisional ballots was 2504. That the whole number of vote by mail voter ballots and the whole number of provisional ballots cast in the City was 2553, making a total of 5057 ballots cast in the City.|101010101010101010 10 10|11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 282. The names of persons voted for at the election for Member of the City Council are as follows: Robert Zirgulis, Jeffrey Cooper, Meghan Sahli-Wells and D. Scott Malsin. 3. The number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective office for which the persons were candidates are as listed in Exhibit "A" attached hereto and made a part hereof. 4. The City Council does declare and determine that D. Scott Malsin is elected as a Member of the City Council for the full term of four years; and Jeffrey Cooper is elected as Member of the City Council for the full term of four years. 5. The City Clerk shall enter on the records of the City Council of the City of Culver City a statement of the result of the election, showing: (1) the whole number of ballots cast in the City; (2) the names of the persons voted for; (3) the office into which each person was voted; (4) the number of votes given at each precinct to each person; and (5) the total number of votes given to each person. 6. The City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated. The City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. City of Culver City, California Agenda Item Report RECOMMENDATION: Staff recommends the City Council adopt a resolution reciting the fact of the General Municipal Election held on April 13, 2010 and stating the results of such Election. BACKGROUND/DISCUSSION: Section 1500 of the City Charter states, in pertinent part: General municipal elections for the filling of all elective offices, other than the Board of Education, shall be held in the City on the second Tuesday in April in each even numbered year. Section 1503 of the City Charter states: Unless otherwise provided by this Charter, all City elections shall be held in accordance with applicable provisions of the then current State law. Elections Code Sections 10263 and 10264 provide: 10263. Upon the completion of the canvass and before installing the new officers, the governing body shall adopt a resolution reciting the fact of the election and the other matters that are enumerated in Section 10264. (a) Except as provided in subdivision (b), the governing body shall meet at its usual place of meeting no later than the fourth Friday after the election to declare the results and to install the newly elected officers. (b) For a consolidated election, the governing body shall meet at its usual place of meeting no later than the next regularly scheduled city council meeting following presentation of the 28-day canvass of the returns, or at a special meeting called for this purpose, to declare the results and to install the newly elected officers. 10264. As soon as the result of the election is declared, the elections official of the governing body shall enter on its records a statement of the result. The statement shall show: (a) The whole number of votes cast in the City. (b) The names of the persons voted for. (c) The measures voted upon. (d) For what office each person was voted for. Pursuant to the City Charter and Resolution 2010-R087 adopted by the City Council on December 7, 2009, the General Municipal Election was held on Tuesday, April 13, 2010. At that Election, two members of the City Council were elected. The City Clerk, in consultation with the City Attorney, has prepared the resolution declaring the results of the election held on Tuesday, April 13, 2010, and declares other matters as are provided for by law. FISCAL ANALYSIS There is no fiscal impact associated with this staff report.
