RECOMMENDATION

 

Staff recommends that City Council adopt a resolution approving a revised salary schedule for City employees effective July 1, 2015.

 

BACKGROUND

 

California Code of Regulations (CCR) §570.5 requires governing bodies to approve and adopt pay schedules for public employees.  All agencies that are members of California Public Employees Retirement System (CalPERS) are required to ensure that pay schedules are publicly adopted and available as prescribed by the California Code of Regulations, Title 2, §570.5 and §571 (b). “Publicly available” is defined as posted at the employer’s office or immediately accessible and available for public review. Placing the adopted pay schedules on the employer’s internet website meets this requirement.

 

DISCUSSION

 

On July 13, 2015, the City Council adopted a Resolution approving a salary schedule for public employees effective July 1, 2015. It was subsequently discovered that updates to certain job classifications were not reflected in the previously adopted salary schedule. Adjustments to the classifications of Police Chief and Solid Waste and Recycling Operations Supervisor were approved in the City Council Adopted Budget for Fiscal Year 2015/2016; however, the salary schedule generated and previously approved via resolution by City Council did not reflect those updates.

 

Contract Employees

 

Staff is proposing to include a new job title, Contract Employee, on the attached non-benefited salary schedule. Currently, the City uses consultants and workers from temporary staffing agencies to supplement regular full-time City staff. The primary reasons that supplemental staff is needed is to fill short-term vacancies for special projects and/or for specialized expertise.

 

Establishing this new job title will avoid potential liability in inadvertently misclassifying a worker. The Department of Labor (DOL) has recently issued new interpretations as it pertains to “independent contractors”. The DOL’s definition of independent contractors is so narrow that it is very difficult to classify a worker as such. In addition, there are potentially other related issues with the Internal Revenue Service (IRS) and CalPERS. With this in mind the City is looking to proactively convert some of our independent contractors to Contract Employees on a prospective basis. This new job title would comply with all three regulatory agencies’ requirements.

 

As previously mentioned, this type of staffing would be used on a limited, short-term basis and would not be assigned regular, ongoing City work. They would only provide extra help on special projects/tasks.  The proposed hourly rate ranges from $20 - $130. The ultimate rate assigned will be determined by the market value of the type of work being performed and what could be supported by the hiring department’s approved budget. Due to the limited number of hours that the Contract Employee will be working he/she will not receive medical benefits but would be eligible to participate in an alternate retirement system and receive paid sick leave in accordance with state law.

 

 

FISCAL ANALYSIS

 

No additional fiscal impact is created by the adoption of the proposed resolution. The associated costs have already been approved and incorporated into the City Council Adopted Budget for Fiscal Year 2015/2016.
