RECOMMENDATION
Staff recommends the City Council conduct a public hearing and adopt a resolution approving the annual assessment levy for Benefit Assessment District West Washington No. 3 for Fiscal Year 2025/2026.
PROCEDURE:
1. Mayor seeks motion to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and,
2. Mayor calls for a staff report, and the City Council Members may pose questions to staff as desired; and,
3. Mayor seeks a motion to open the public hearing; and,
4. Mayor seeks a motion to close the public hearing after all public testimony has been presented; and
5. City Council discusses the item and arrives at its decision.
BACKGROUND
In August of 2019 the West Washington Benefit Assessment District No. 3 (District 3) was approved by vote of the property owners to construct seven medians located between Beethoven Street and Glencoe Avenue. Construction of the medians was initially delayed due to the COVID-19 pandemic and then due to a redesign of the affiliated stormwater project. The stormwater project is a partnership between Economic Development and Public Works to provide grey water irrigation for the medians from collection cisterns located near Glencoe Avenue.
The project was recently bid for new construction estimates and the responses are currently under review with the Public Works Department. Although there are no improvements at this time, it is anticipated that construction of the medians will begin by the end of the calendar year. The proposed budget includes a pro-rata estimate to fund landscaping, water, electrical and administrative costs to maintain the new improvements.
DISCUSSION
On June 9, 2025, the City Council approved the Engineer's Report, declared its intention to order the assessment levy and collect assessments, and set the date, time, and place for this public hearing.
Pursuant to Section 15.01.070.H of the Culver City Municipal Code (CCMC), any interested persons may file a written protest with the City Clerk (or withdraw a previously filed protest) until the conclusion of the Public Hearing. Pursuant to CCMC Section 15.01.070.K, the City Council shall not impose an increased assessment if there is a majority protest. In this case, for Fiscal Year 2025/2026, the Engineer’s Report does not propose an assessment increase above the voter approved maximum rate, which is adjusted annually in accordance with the Consumer Price Index. Therefore, the majority protest proceedings do not apply, and the City Council may, after receiving public comment, adopt the resolution confirming the assessment as determined by the Engineer’s report.
FISCAL ANALYSIS
The Engineer’s Report for Fiscal Year 2025/2026 estimates the annual costs for maintenance and administration to be approximately $13,418.75. The City will be required to contribute approximately $1,155 or 8.61% of the levy as its General Benefit obligation relative to aesthetic benefit for pass-through vehicular traffic. The proposed levy to be assessed is $12,263.66.
