RECOMMENDATION
Staff recommends the City Council (1) approve a two-year professional services agreement with CWE for Industrial General Permit (IGP) Stormwater Compliance Consultant Services, in an annual amount not-to-exceed $75,000; and (2) authorize the City Manager to approve two additional one-year terms for an annual amount not-to-exceed $75,000.
BACKGROUND/DISCUSSION
The Industrial General Permit (IGP) regulates industrial storm water discharges and authorized non-storm water discharges from industrial facilities in California. Two City facilities, the Transfer Station and the Transportation Building, fall under IGP coverage. The IGP requires minimum best management practices (BMPs), including good housekeeping, preventive maintenance, spill and leak prevention and response, material handling and waste management, erosion and sediment controls, an employee training program, and quality assurance and record keeping. All dischargers are required to submit and certify reports electronically to the State Water Resource Control Board (SWRCB). Further, the IGP also requires stormwater effluent sampling events during which samples are collected from each drainage area onsite, and generation of response plan and technical reports if there is an exceedance.
Due to the operations at the Transfer Station facility and its proximity to a heavily-travelled roadway with airborne pollutants from vehicular traffic, exceedances in pollutants have occasionally occurred in required stormwater monitoring reports, leaving the City vulnerable to liability and fines from the Regional Board and other parties. The Transfer Station is currently under Consent Decree with the LA Waterkeeper for exceedances and is in the process of designing a project that will re-route all site discharges to the sewer in order to protect watershed health.
The Department contacted firms in April 2025 for specialized consulting services to advise on reducing the pollutant exceedances and implementing best management practices on site, including enhanced sweeping programs, filtration systems, and other activities to ensure compliance with the Consent Decree. The Department would like to initiate a two-year contract with CWE for all stormwater compliance services, including updating and revising the facility’s Storm Water Pollution Prevention Plan (SWPPP); providing storm water sampling supplies, training, and pickup services; laboratory analysis of stormwater samples; conduct stormwater site inspections; prepare annual stormwater reports; perform exceedance response action (ERA) and water quality based corrective action (WQBCA) inspections and reports; managing compliance with all aspects of the Consent Decree; review and compile laboratory data and prepare ad-hoc reports in the Stormwater Multiple Application and Report Tracking Systems (SMARTS); among other tasks.
In accordance with Culver City Municipal Code section 3.07.065, staff solicited proposals for these professional services. The proposals were evaluated based on the firm’s understanding of the project scope of work; firm’s qualifications and experience with similar project; schedule; and cost effectiveness. Staff determined CWE to be the best qualified.
FISCAL ANALYSIS
The Proposed Budget for Fiscal Year 2025-2026 includes sufficient funding for this agreement in in Account No. 20260410.600100 (Refuse Fund Transfer Station - R&M Building). If approved, funding for the remainder of the agreement term will be included in future fiscal year budgets.

3. Authorize the City Attorney to review/prepare the necessary documents; and
4. Authorize the City Manager to execute such documents on behalf of the City.
