RECOMMENDATION

 

Staff recommends the City Council (1) adopt the proposed resolution (Attachment No. 1) confirming the Culver City Arts District 2024 work program (Work Plan) and the levy of assessments for the Culver City Arts District Business Improvement District (BID); and (2) appoint members to the BID Advisory Board for calendar year 2024.

 

 

PROCEDURE

 

1.                     Mayor seeks motion from City Council to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and,

2.                     Mayor calls for a staff report, and the City Council Members may pose questions to staff as desired; and,

3.                     Mayor seeks a motion to open the public hearing; and

4.                     Mayor seeks a motion to close the public hearing after all public testimony has been presented; and,

5.                     The City Council discusses the item and arrives at its decision.

 

 

BACKGROUND/DISCUSSION

 

The BID renewal process is governed by the California Streets and Highways Code, Sections 36500-36551. In accordance with the process prescribed therein, on October 23, 2023, the City Council approved the 2024 BID Annual Work Plan and Budget (Attachment No.2) and adopted a Resolution of Intention to conduct a public hearing on November 13, 2023, to consider continuation of the BID program and the levy of assessments in 2024.

 

The proposed 2024 work plan includes:

 

                     Marketing and promotional activities.

                     Maintenance and beautification

                     Advocacy and administration

 

Annual assessments are collected by the City and disbursed to the CCAD, which manages the Work Plan in accordance with the Management Agreement between the City and the CCAD.  Assessment funds collected may only be spent on programs/ activities that benefit the BID.

 

If there is a majority protest (i.e. if protests are received from the owners in the proposed district who will be paying 50 percent (50%) or more of the proposed assessment), the City Council is required to adopt a finding that a majority protest occurred and that, therefore, no further proceedings to renew the BID can occur for a period of one year.

 

Advisory Board

 

State law requires the City Council to appoint an advisory board to prepare and submit the Annual Work Plan and Budget. The City Council may appoint the persons recommended by the CCAD or choose other individuals for appointment to the Board.

 

The CCAD recommends the following persons be appointed to the 2024 BID Advisory Board:

 

                     Josetta Sbeglia

                     Janiece Heyward

                     Maya Roth

                     Noah Baylin

                     Lee Chernotsky

                     Danaan Whitney

                     Francesco Sinatra

 

*There are currently 2 vacant spaces on the Board that will be filled as soon as possible.

 

 

FISCAL ANALYSIS

There is no fiscal impact to the City by approving an annual renewal of the BID. Expenses relative to the collection and distribution of the BID assessments, and staff time spent preparing and presenting reports are offset by the City’s two percent (2%) administrative fee included in the 2024 Work Plan and budget.

MOTION

 

That the City Council:

 

1. (In the event a majority protest is received) Adopt a finding that protests have been received from the owners of businesses in the proposed district who will pay 50 percent (50%) or more of the assessment proposed to be levied and that, therefore, no further proceedings to continue the Culver City Arts District Business Improvement District can be taken for a period of one year from the date of this Public Hearing; or,

 

2. (Absent a majority protest) Adopt the proposed resolution confirming the Business Improvement District Advisory Board’s Annual Report and the levy of the Culver City Arts District Business Improvement District Assessment for Calendar Year 2024; and, 

 

3. Appoint the 2024 Advisory Board as recommended by the Culver City Arts District Business Improvement District; and, 

 

4. Authorize the City Attorney to review/prepare the necessary documents; and,

 

5. Authorize City Manager to execute such documents on behalf of the City
