RECOMMENDATION:
Staff recommends the City Council award construction contracts to FS Construction
and Torres Construction to provide on-call services to perform necessary work for
the City’s Minor Pavement and Infrastructure Maintenance and Repair Program, P-
554, in support of the Public Work Department for a total aggregate not-to-exceed
cost of $100,000. Staff is proposing that the contracts expire June 30, 2007.
BACKGROUND:
The Public Work Department receives numerous requests from residents, business
owners, and city staff regarding minor roadway pavement and infrastructure repair
work citywide. The Public Work Street Maintenance Division responds and
addresses the majority of the requests. However, due to reduction of staffing
resulting from early retirements and layoffs in fiscal year 2002/2003 the Public
Works Department Maintenance and Operations Division has to prioritize and
respond to higher priority repair work. As a result there is an increased backlog of
minor street repair work.
In support of the Maintenance Division, the Engineering Division has assisted in
relieving some of the repair backlog by incorporating it into Capital projects.
However, some of the minor repair work is time sensitive and cannot be postponed
until a scheduled Capital project begins construction. In cases like these,
Engineering Division Staff has to look at related repair work that can be combined
into a project in order to obtain competitive bids. The inefficiency of the existing
process has resulted in limited progress in reducing the Maintenance Division

backlog and has consumed valuable time for Engineering Division staff to coordinate
the piecemeal minor repair projects.
DISCUSSION
In order to effectively support the Maintenance Operations Division, the Engineering
Division recommends that the City Council award contracts with on-call contractors
to provide construction support services under the City’s Minor Pavement and
Infrastructure Maintenance and Repair Program, P-554. The purpose of the on-call
contractor is to provide immediate response to the needed repair work, provide
competitive pricing on an as needed basis, and reduce the minor street maintenance
backlog.
Selection Process
Engineering Staff has established selection criteria based on the following,
1. Possession of a General Engineering Contractor’s (Class A or C-8) License.
2. Experience and ability to perform all bid items being mentioned in the RFP.
3. Related experience with municipal agency projects.
4. Proposes total base bid and unit prices.
5. Availability to perform the work as requested.
Request for Proposal
Engineering Staff advertised in local plan rooms and directly sent Request for
Proposals to the following four (4) general contractors who has submitted
competitive bids in past Capital Improvement Projects,
1. Kalban, Inc., Sun Valley
2. Torres Construction, Los Angeles
3. FS Construction, Sylmar
4. Excel Paving Company. Long Beach
Proposals Received
Staff has reviewed the proposals submitted by both FS Construction and Torres
Construction and found the proposals to be complete and responsive. The unit
prices are reasonable.
FS Construction and Torres Construction have successfully completed Curb, Gutter,
and Sidewalk Replacement Projects for the City. FS Construction has also worked
on the Citywide Curbcut Projects and other miscellaneous projects citywide. FS City of Culver City, California

Construction and Torres Construction exemplified excellent workmanship and
professionalism and were responsive to public safety and traffic.
Engineering Division staff will perform the construction management and
construction inspection for the City’s Minor Pavement and Infrastructure
Maintenance and Repair Program, P-554.
FISCAL ANALYSIS:
There is $50,000 appropriated in P-554 Minor Pavement Improvement Program in
the Capital Improvement Program Budget for Fiscal Year 2005/06 with Improvement
& Acquisition funds (Business Unit 42000554).
The additional $50,000 will be requested as part of the Fiscal Year 2006/2007
budget.

MOTIONS:
That the City Council:
1. Approve construction contracts with FS Construction and Torres Construction

2. Direct the Public Works Director and City Engineer to negotiate new unit

Administrative Officer to approve the documents.

furnishing all labor services materials and equipment and performing all work necessary for

Having carefully examined the Bid Documents for the proposed work and read the accompanying
proposed requirements and attended the pre bid conference the undersigned Proposer hereby
proposes and agrees to enter into a contract to furnish all equipment materials and labor necessary to
complete all work described in the Bid Documents for the duration of thirty six (36) months under the
supervision of the City Engineer of the City of Culver City for the sum set forth provided that the unit
prices can be increased or shall be decreased based on the Engineering News Record Material Cost
Index after twelfth (12th) month of the contract award and every twelve (12) months thereafter until
completion of the contract as approved by the City Engineer Please note a base line will be
established at the time of contract award In this Project the work is divided into Specific Work The
Notice to Proceed for each Specific Work will state the bid items of work to be used the quantity of
each bid item and the scheduled number of days for the construction Each Specific Work will be a
minimum of Five Thousand Dollars, ($ 5,000) of work
Liquidated damages shall be assessed based upon the applicable number of days stated in the Notice
to Proceed The Contract Time shall commence on the date the Contractor actually commences the
Work or on the tenth (10th) day after the issuance of the Notice to Proceed which ever comes first
The Contractor shall retain the right to fully complete (including Final Completion Punch List
Correction and project Close Out) the Work in less days than established by above however neither
shall a reduction or increase to the Contract Sum be made if the Work is so fully completed in less
days than established by this Section B 1 nor shall a Claim be made or granted for Compensable
Delay or any other increase in Contract Sum if for any reason including but not limited to delay
caused by the Owner the Contractor does not so fully complete the Work in less days than established

This Bid is submitted in accordance with the advertised Notice Inviting Bids requesting sealed bids for
furnishing all labor services materials and equipment and performing all work necessary for
MINOR PAVEMENT AND INFRASTRUCTURE
MAINTENANCE AND REPAIR PROJECT, P-554
Having carefully examined the Bid Documents for the proposed work and read the accompanying
proposed requirements and attended the pre bid conference the undersigned Proposer hereby
proposes and agrees to enter into a contract to furnish all equipment materials and labor necessary to
complete all work described in the Bid Documents for the duration of thirty six (36) months under the
supervision of the City Engineer of the City of Culver City for the sum set forth provided that the unit
prices can be increased or shall be decreased based on the Engineering News Record Material Cost
Index after twelfth (12th) month of the contract award and every twelve (12) months thereafter until
completion of the contract as approved by the City Engineer Please note a base line will be
established at the time of contract award In this Project the work is divided into Specific Work The
Notice to Proceed for each Specific Work will state the bid items of work to be used the quantity of
each bid item and the scheduled number of days for the construction Each Specific Work will be a
minimum of Five Thousand Dollars, ($ 5,000) of work
Liquidated damages shall be assessed based upon the applicable number of days stated in the Notice
to Proceed The Contract Time shall commence on the date the Contractor actually commences the
Work or on the tenth (10th) day after the issuance of the Notice to Proceed which ever comes first
The Contractor shall retain the right to fully complete (including Final Completion Punch List
Correction and project Close Out) the Work in less days than established by above however neither
shall a reduction or increase to the Contract Sum be made if the Work is so fully completed in less
days than established by this Section B 1 nor shall a Claim be made or granted for Compensable
Delay or any other increase in Contract Sum if for any reason including but not limited to delay
caused by the Owner the Contractor does not so fully complete the Work in less days than established
herein

If awarded the Contract by the Owner Proposer agrees that additive or deductive Change Orders not covered
by Unit Prices shall be handled as follows
A For Change Orders which result in additional Work not covered by Unit Prices the
Proposer shall perform such Work and the amount of the additive Change Order shall
be the Proposers cost of the additional Work which Shall not include Proposers or
Sub Proposer s overhead/general conditions and profit/fee as agreed to by the Owner
(the Trade Cost ) plus percentage amounts of the Trade Cost for Proposer s and
Sub Proposers overhead/general conditions and profit/fee which shall be limited as
follows
1 For additional work performed by Proposers own forces Proposers
mark ups shall not exceed eight percent (8 0%) of the Trade Cost for
overhead/general conditions and four percent (4 0%) of the Trade Cost for
profit/fee
2 For additional work performed by Sub Proposers Proposers mark ups shall
not exceed five percent (5 0%) of the Trade Cost for overhead/general
conditions and four percent (4 0%) of the Trade Cost for profit/fee
3 For additional work performed by Sub Proposers the Sub Proposers
mark ups shall not exceed eight percent (8 0%) of the Trade Cost for
overhead/general conditions and four percent (4 0%) of the Trade Cost for
profit/fee
For Change Orders which result in reductions in the scope of the Work not covered by
Unit Prices the Proposer shall comply with such Change Orders and the amount of
the deductive Change Order shall be the Trade Cost of the Work to be deleted plus
percentage amounts of the Trade Cost for the Proposer s and Sub Proposer s
overhead/general conditions and profit/fee which shall be as set forth in paragraph A
