RECOMMENDATION

 

Staff recommends the City Council (1) approve a two-year professional services agreement with CWE for Industrial General Permit (IGP) Stormwater Compliance Consultant Services, in an amount not-to-exceed $87,610 per year; and (2) authorize the City Manager to approve two additional one-year terms for an amount not-to-exceed $87,610 per year.

 

 

BACKGROUND

 

The Industrial General Permit (IGP) regulates industrial storm water discharges and authorized non-stormwater discharges from industrial facilities in California. Two City facilities, the Transfer Station and the Transportation building, fall under the IGP coverage. The IGP requires minimum best practices, including good housekeeping, preventive maintenance, spill and leak prevention and response, material handling and waste management, erosion and sediment controls, an employee training program, and quality assurance and record keeping. All dischargers are required to submit and certify reports electronically to the State Water Resource Control Board. Further, the IGP also requires stormwater effluent sampling events during which samples are collected from each drainage area onsite, and generation of response plan and technical reports if there is an exceedance.

 

Due to the operations at the Transportation facility and its proximity to a heavily travelled roadway with airborne pollutants from vehicular traffic, exceedances in pollutants have occasionally occurred in required stormwater monitoring reports, leaving the City vulnerable to liability and fines from the Regional Board and other parties.

 

The Department of Public Works contacted firms in April 2025 for specialized consulting services to advise on exceedances and implementing best management practices on site, including enhanced sweeping programs, filtration systems, and other activities to ensure compliance with the consent decree. On May 27, 2025, the City Council approved the award of this contract to CWE in the amount of $75,000 in an annual not-to-exceed for two years with the authorization for the City Manager to approve two additional one-year terms. The Department of Public Works has been satisfied with the work performed to date by CWE. In November 2025, thehe Transportation Department reached out to CWE for a quote to provide stormwater compliance services for the Transportation Building  . CWE provided a quote in an amount not-to-exceed $87,610 per year.

 

Pursuant to Culver City Municipal Code Section 3.07.065 the City may award contract for professional services based upon competitive quotations, whenever practical as determined by the City Manager. Since Public Works recently underwent a competitive procurement process for a similar scope of work, selected CWE and is satisfied with the work CWE has performed and there are practical benefits to the City for contracting with the same firm for stormwater compliance services across multiple facilities, it is not practical for the Department of Transportation to solicit competitive quotes at this time.

 

 

FISCAL ANALYSIS

 

The Adopted Budget for Fiscal Year 2025-2026 includes sufficient funding for this agreement in Account No. 20370200.619800 (Transportation Operations - Other Contractual Services) which can be found in the Transportation Department section of the budget book on page 552. If approved, funding for the remainder of the agreement term will be included in future fiscal year budgets.

That the City Council:

 

1.                     Approve a two-year professional services agreement with CWE for Industrial General Permit (IGP) Stormwater Compliance Consultant Services, in an  amount not-to-exceed $87,610 per year;

 

2.                     Authorize the City Manager to approve two additional one-year terms, in an additional amount not-to-exceed $87,610 per year;

 

3.                     Authorize the City Attorney to review/prepare the necessary documents; and

 

4.                     Authorize the City Manager to execute such documents on behalf of the City.
