RECOMMENDATION
Staff recommends the City Council adopt an ordinance approving City-initiated Zoning Code Amendment P2025-0229-ZCA amending various sections of Title 17: Zoning Code to implement programs of the 2021-2029 Housing Element and conform to State law and approve an exemption under the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3).
BACKGROUND
The Planning Commission held a public hearing to consider the amendment on November 12, 2025. Following discussion, the Planning Commission unanimously adopted Resolution No. 2025-P014, recommending City Council approval of the amendment and CEQA exemption.
The City Council public hearing was held on February 9, 2026. The City Council voted unanimously to introduce the proposed ordinance approving the proposed amendments and adopting the CEQA exemption, as shown in Attachment 1.
DISCUSSION
The proposed ordinance implements Measure 4B of the 2021-2029 Housing Element and Assembly Bill 1397, allowing ministerial approval of housing projects providing a minimum 20% of units affordable to lower income households and requiring residential use for a minimum 50% of total floor area of a mixed use project on a mixed use site designated for lower-income housing on the Housing Element Sites Inventory.
The proposed ordinance and Zoning Code Amendment is presented for adoption by the City Council.
ENVIRONMENTAL DETERMINATION
Pursuant to the California Environmental Quality Act (CEQA) Guidelines, the adoption of the proposed Zoning Code Amendment is exempt per Section 15061(b)(3), common sense exemption, because it can be seen with certainty there is no possibility the Amendment will have a significant effect on the environment. The Amendment proposes revisions to implement the 2021-2029 Housing Element and align with State law. The changes do not result in changes to existing land use, density, or an intensification of development beyond what the Zoning Code currently allows.
FISCAL ANALYSIS
The proposed Zoning Code Amendment has no anticipated fiscal impact to the City.
