Nachbar (01/23/13) RECOMMENDATION: Staff recommends the City Council approve amendments to existing Personal Services Agreements with Ayala Engineering, Amireh Sewer Contractor and Escobar Contracting, Inc. for on-call sewer repairs in an aggregate not-to-exceed amount of $100,000. BACKGROUND/DISCUSSION: In 2004, the City Council amended Chapter 5.02 of the Culver City Municipal Code to place responsibility for maintenance of the connecting structure (wye) to a City sewer main solely upon the City instead of the property owner. As a result of this revised ordinance, the City has utilized sewer contractors to repair the connecting structure to the City sewer main. The $30,000 administrative authority for the personal services agreements for on- call sewer repairs with Ayala Engineering, Amireh Sewer Contractors, and Escobar Contracting has been reached for this fiscal year. Some of the repairs were costly due to the replacement of sections of the sewer main that were discovered to have cracks in them. Pursuant to Culver City Municipal Code § 3.07.085.A, a contract for professional and personal services may be awarded without complying with formal competitive bidding procedures; provided, the contract is based upon competitive quotations, whenever practical, as determined by the City Manager. Ayala Engineering, Amireh Sewer Contractor and Escobar Contracting are reputable local sewer contractors with many years of sewer repair experience in Culver City. City of Culver City, California Agenda Item Report They are immediately available for sewer repairs and their costs are very reasonable. The contractors are properly licensed, bonded, and insured. Based on these factors, it has been determined by the City Manager that competitive quotations are not necessary in this case. The proposed amendment to the agreements, if approved by the City Council, will expire on June 30, 2013. FISCAL ANALYSIS: The City Council approved capital improvement plan as part of the City Council Adopted Budget for Fiscal Year 2012/2013 includes sufficient funding in P-230 Sewer Localized and Emergency Repairs project for this proposal. MOTIONS: That the City Council: 1) Approve amendments to existing Personal Services Agreements with Ayala Engineering, Amireh Sewer Contractor and Escobar Contracting Inc. for on- call sewer repairs in an aggregate not-to-exceed amount of $100,000, and expiring on June 30, 2013. 2) Authorize the City Attorney to review/prepare the necessary documents; and, 3) Authorize the City Manager to execute such documents on behalf of the City.
