RECOMMENDATION:
Staff recommends the City Council adopt a Resolution (Attachment 1) approving the
application for grant funds in the amount of $162,805 from the Baldwin Hills
Conservancy for Proposition 40 Funding for the Culver City Skateboard Park Project
(P-830).
Staff also recommends the City Council approve a budget amendment to
appropriate the funding for this project upon the approval of the grants application
and a signed documentation received by the City.
A four-fifths vote is necessary to approve the budget amendment.
BACKGROUND/DISCUSSION:
The temporary Skateboard Park was developed in late 1999 to address a pressing
need of local youth who had nowhere to practice their sport. It was generally known
through the years that the facility was merely a temporary solution to provide a
designated area to serve the skateboarders. The new permanent facility will allow
twice the area while providing increased challenges through well-planned features
that are designed for both maximum safety and enjoyment.
In response to the needs of local youth, the City Council approved submission of a

Park Project at the April 28, 2003 Council meeting. Matching funds were identified
from the City’s Proposition 12 and 40 Per Capita funds. The LWCF grant was
approved for funding in the amount of $204,000. At the August 22, 2005 City
Council meeting, City Council awarded a professional services agreement to SITE
Design Group, Inc. to design a permanent Skateboard Park at Culver City Park. On
August 25, 2005 staff conducted the first of a series of public meeting with SITE
Design Group. It was through this public process that both the design of the
Skateboard Park and its location were determined.
On August 8, 2006 the City Council approved the plans and specifications and
authorized staff to advertise for bids for the construction of the Skateboard Park
Project (P-830). The project was not advertised for bids until January 11, 2007 due
to delays resulting from Site Design’s inability to deliver the final plans and
specifications to the City. Two bids were publicly opened by the City Clerk on
February 15, 2007. These bids were over the amount of the available construction
budget. On March 12, 2007, the City Council took action to reject all bids and
authorized staff to negotiate with the two bidders for a lower price per the City
Charter.
On March 26, 2007, an informational report on the status of discussions with 4-Con
Engineering and California Landscape and Design, dba California SkatePark was
presented to the City Council. In a component of that report, Council authorized
staff to submit an application for Proposition 40 Roberti-Z’Berg-Harris (RZH) Block
Grant Funds in the amount of $107,908 to enhance funding for the project. Parks &
Recreation and Community Services Department staff has submitted the application
pursuant to Council’s direction. Staff has been assured by the State that if other
substitute funding is found for the project, this request for Proposition 40 RZH funds
can be withdrawn at any time before a progress payment has been requested.
On April 9, 2007 the City Council awarded the construction contract for the
Skateboard Park Project to California Skateparks, Inc. Council was informed at that
time that staff had been in contact with Mr. David McNeill, Executive Director of the
Baldwin Hills Conservancy, and that he mentioned that the Baldwin Hills
Conservancy might be interested in applying for and then allocating, if granted,
funding to cover the shortfall in the project funding. There was general consensus of
the Council that staff should continue to seek other sources of funding for the
construction of the Skateboard Park.
In an email dated May 1, 2007, staff was encouraged by Mr. McNeill to submit an
application at the Baldwin Hills Conservancy May 18, 2007 meeting to the Baldwin
Hills Conservancy Board for Proposition 40 funds. The deadline for submission was
May 2, 2007. Staff submitted the grant application to the Baldwin Hills conservancy City of Culver City, California

with the understanding that the City Council would consider the resolution needed to
accompany the application at its May 14, 2007 meeting.
FISCAL ANALYSIS:
The purpose of this grant application is to secure funding to supplant the $107,908 in
requested Proposition 40 RZH Block Grant funds previously allocated to the City of
Culver City and the $54,897 in General Fund Reserve appropriated to the
Skateboard Park Project by Council at its April 9, 2007 meeting. As shown in the
table below, the amount requested is $162,805.

MOTION:
That the City Council:
1. Approve the Resolution for the application for Proposition 40 grant funds through
the Baldwin Hills Conservancy for the Culver City Skateboard Project (P-830).
2. Authorize the City Manager to sign all documents related to the submittal of the
Proposition 40 grant application to the Baldwin Hills Conservancy.
3. Approve a budget amendment to appropriate the funding when the Grant is
approved and signed

RESOLUTION NO. 2007-R
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CULVER CITY, CALIFORNIA, APPROVING THE
APPLICATION FOR GRANT FUNDS FROM THE BALDWIN
HILLS CONSERVANCY FOR PROPOSITION 40 FUNDING
FOR THE CULVER CITY SKATEBOARD PARK PROJECT.
WHEREAS, the people of the State of California on March 5, 2002, enacted
State of California Proposition 40, the California Clean Water, Clean Air, Safe
Neighborhood Parks, and Coastal Protection Act of 2002, which among other uses,
provides funds to public agencies and nonprofit organizations in the State for the purpose
of development, restoration, and acquisition of state and local parks, recreation areas and
historical resources, and for land, air, and water conservation programs; and
WHEREAS, the Baldwin Hills Conservancy has set forth the necessary
procedures governing application for grant funds under the Proposition; and
WHEREAS, the Conservancy's procedures require the City Council of the
City of Culver City to certify, by resolution, the approval of the application before
submission of said application(s) to the Conservancy; and
WHEREAS, said application contains assurances that the City Council of
the City of Culver City must comply with; and
WHEREAS, the City Council of the City of Culver City will enter into an
Agreement with the Conservancy to provide funds for acquisition and development
projects.
NOW, THEREFORE, the City Council of the City of Culver City, California

2. Certifies that the City Council of the City of Culver City understands
the assurances and certification in the application form; and
3. Certifies that the City Council of the City of Culver City has, or will
have, sufficient funds to operate and maintain the project in perpetuity; or has the right to
assign maintenance to another agency; and
4. Authorizes and appoints the City Manager of the City of Culver City
or designee, to conduct all negotiations, and to execute and submit all documents
including, but not limited to, applications, agreements, amendments, payment requests
and so forth, which may be necessary for the completion of the aforementioned project.
