RECOMMENDATION:
Staff recommends the City Council accept the work performed by the contractor, FS
Construction, and authorize filing a Notice of Completion for the Curb, Gutter, and
Sidewalk Replacement Project, P-428. It is also recommended that the retention
funds in the amount of $7,547.50 be released to the contractor after the thirty-five
day lien period.
BACKGROUND/DISCUSSION:
On May 22, 2006, the City Council awarded a construction contract to
FS Construction for the replacement of uplifted, damaged or deteriorated sidewalks,
drive approaches, and curb and gutter along selected streets. Due to the favorable
low bid, the City Council also authorized staff to negotiate additional work not
exceeding the project budget of $76,458.69.
FS Construction completed the replacement of the sidewalks, curb and gutter, and
drive approaches as required in the original contract. The original contract amount
for the project was $57,180.00 and the final construction cost was $75,475.00.
There were three (3) change orders issued in the total amount of $18,295.00 for
additional replacement of curb, gutter, sidewalk, and drive approaches that were
added to the project.
The project was designed, managed, and inspected by Engineering Division staff.

FISCAL ANALYSIS:
Adequate Gas Tax funding was appropriated for this project, including the change
orders, in Fiscal Year 2005/06 within the Capital Improvement Program Budget in
the Curb, Gutter, and Sidewalk Replacement Project, P-428 (Business Unit
41800428 and 42000428). This appropriation was carried over (as construction in
progress) to Fiscal Year 2006/2007 and is available for this expenditure.

That the City Council:
1) Accept the work performed by the contractor, FS Construction, for the Curb,
Gutter, and Sidewalk Replacement Project, P-428;
2) Authorize the issuance of a Notice of Completion;
3) Authorize the Public Works Director/City Engineer to sign and submit the
necessary documents to the Los Angeles County Recorder’s Office; and,
4) Authorize the release of $7,547.50 to FS Construction following the 35-day lien
period.
