Nachbar (01/23/13) RECOMMENDATION: Staff recommends the City Council award a contract to Malibu Pacific Tennis Courts, Inc., as the lowest responsive and responsible bidder, in the base amount of $93,999 for the construction of the Fox Hills Park Playground Project, PZ-958. BACKGROUND: At the August 6, 2012 City Council meeting, the City Council (1) approved the purchase of Kompan playground equipment in an amount not to exceed $96,000 from U.S. Communities; (2) approved the final plans and specifications; and, (3) authorized the publication of a notice inviting bids for the Fox Hills Park Playground Project (PZ-958). Should the City Council award this contract, the Fox Hills Park Playground will experience a complete renovation of the playground area for children ages 2 – 5 and the area for children ages 5 – 12. State-of-the-art equipment will be installed to promote a variety of physically and mentally challenging play activities. The installation of ADA ramps will provide accessible routes for children of all ages and abilities. The existing sand fall surface will be replaced with Engineered Wood Fibar, which is also an American Society for Testing and Materials (ASTM) certified accessible surface and safe loose fill fall surface. Taken together, these improvements will make the new playground 100% accessible. City of Culver City, California Agenda Item Report DISCUSSION: On November 26, 2012, the City Clerk’s Office staff publicly opened the bids. Nine contractors responded with the following bid amounts: 1 Malibu Pacific Tennis Courts, Inc. $ 93,999.00 2 Creative Nile Builders, Inc. $ 114,200.00 3 Cicero Engineering $ 117,796.00 4 RE Schultz Construction $ 120,360.00 5 Greenland Construction, Inc. $ 148,850.00 6 G2K Construction, Inc. $ 146,000.00 7 Fast Track Construction Corp. $ 156,974.00 8 ADDSCAPE $ 162,750.00 9 New Visions Construction $ 167,020.00 Staff reviewed the nine sets of contractor bid documents and determined that Malibu Pacific Tennis Courts, Inc. submitted the lowest total base bid. Staff reviewed the bid proposal from Malibu Pacific Tennis Courts, Inc. and found its bid responsive and complete. Its bid bond, contractor’s license, and worker’s compensation insurance were reviewed and determined to meet City requirements. Construction management and inspection of the project will be conducted by City staff. FISCAL ANALYSIS: There are currently sufficient funds available for the construction of the Fox Hills Park Playground Project in Capital Improvement and Acquisition (General) Funds Account Number 42080000.730100.PZ958 of the City Council Adopted Budget for Fiscal Year 2012/2013. In addition to the base bid amount of $93,999, staff is requesting authority to approve up to $20,000 for contingencies (for a total not-to- exceed amount of $113,999). MOTIONS: That the City Council: 1. Award a contract to Malibu Pacific Tennis Courts, Inc., as the lowest responsive and responsible bidder, for the Fox Hills Park Playground Project, PZ-958, in the amount of $93,999 based on its base bid; and, 2. Authorize the Parks Division Manager to approve change orders in an amount not-to-exceed $20,000 if necessary; and, City of Culver City, California Agenda Item Report 3. Authorize the City Attorney to review/prepare the necessary documents; and, 4. Authorize the City Manager to execute such documents on behalf of the City.
