RECOMMENDATION:
Staff recommends the City Council adopt an Ordinance amending Chapter 1.01 of
the Culver City Municipal Code (CCMC) relating to general penalty provisions,
renumbering Chapter 1.02 to 1.03, and adding a new Chapter 1.02 to the CCMC
relating to the enforcement of the CCMC through an administrative citation process,
and waive further reading.
BACKGROUND/DISCUSSION:
At the City Council meeting of February 11, 2008, the Council introduced the
Ordinance by a unanimous vote (5-0). Prior to its introduction, staff read into the
record certain revisions to the Ordinance and the Council suggested certain
revisions from the dais. Such revisions are not of a substantive nature and do not
require re-introduction of the Ordinance. The revisions are as follows:
1. CCMC Section 1.01.035.F was revised to clarify that a continuing violation may
be charged as a separate offense each and every day it continues.
2. CCMC Section 1.02.040(2) was revised to clarify that it is only under certain
circumstances that a fine may be avoided if a violation is corrected. Such
revision is consistent with the provisions of California Government Code Section
53069.4.

3. CCMC Section 1.02.045.D.3 was revised to include language allowing for
additional continuances of a hearing for good cause.
4. CCMC Section 1.02.020 was revised to include the Enforcement Services
Manager as one of the individuals who could authorize the use of the
Administrative Citation process.
5. CCMC Section 1.02.030(8) was revised to clarify that the content of every
citation shall include the time period within which the violation must be corrected.
6. Several miscellaneous typographical, grammatical or other non-substantive
changes.
The Ordinance, as revised, is brought back tonight for adoption.
FISCAL ANALYSIS:
At this time, there is no fiscal impact associated with this action. While there would
be an increased revenue stream from the administrative fines levied, it would not
significantly offset the costs to maintain the current program. As code enforcement
is extremely labor-intensive to implement, the ultimate objective of the program
would be increased code compliance throughout the community.
