RECOMMENDATION:

 

Staff recommends the City Council and the Successor Agency to the Culver City Redevelopment Agency Board (Successor Agency Board) approve a Fifth Amendment to the Agreement with Modern Parking, Inc. (Modern) for parking management services at the Cardiff, Ince, and Watseka parking structures and the Venice and Virginia parking lots to (1) extend the term of the Agreement for an additional three months to April 30, 2016, (2) authorize the City Manager/Executive Director to approve additional extensions beyond April 30, 2016 on a month-to-month basis, not to exceed an additional six months; and (3) increase the not-to-exceed amount by an additional $668,295.90.

 

 

 

 

BACKGROUND/ DISCUSSION:

 

On August 1, 2006, the former Culver City Redevelopment Agency (Former CCRA) Board approved an agreement with Modern for parking management services related to the Cardiff, Ince, and Watseka parking structures (Agreement).  In subsequent amendments to the Agreement, the Former CCRA Board and the City Council extended the term of the Agreement and added additional management and maintenance services to Modern’s scope of work. The extensions were provided with the intent of eventually issuing a new Request for Proposals (RFP) to obtain bids from qualified firms to maintain and operate the City’s parking facilities. During this period the City commissioned the Walker Downtown Comprehensive Parking Study and a subsequent update to assess city parking operations and provide recommendations. The dissolution of redevelopment agencies and potential loss of the City’s parking assets contributed to the delay in obtaining bids for parking operation services and implementation of the recommendations of Walker’s Study.

 

On March 18, 2014, the State Department of Finance approved the Successor Agency’s Long Range Property Management Plan, which authorized transfer of ownership of the parking facilities from the Successor Agency to the City. 

 

Extension of Term of Agreement

 

In order to revisit the recommendations of Walker Parking and provide sufficient time to issue a Request for Proposals (RFP) to qualified parking companies, staff recommends approval of an additional three-month extension to the agreement with Modern from January 31, 2016 to April 30, 2016.  In addition, staff is recommending the City Council/Successor Agency Board authorize the City Manager/Executive Director to approve, at his discretion, additional extensions beyond April 30, 2016 on a month-to-month basis, not to exceed an additional six months.  Any extensions approved shall be under the existing terms and conditions. 

 

Contract Funding Increase

 

Staff is recommending the City Council/Successor Agency Board increase the not-to-exceed amount of the Agreement by an additional $668,295.90, which includes: (1) the cost for the initial three-month extension ending April 30, 2016 not-to-exceed ($222,765.30); and (2) if needed, the cost for the additional month-to-month extensions up to a six-month period beyond April 30, 2016 in an amount not-to-exceed ($445,530.60 $74,255.10 per month).

 

 

 

 

FISCAL ANALYSIS:

 

The requested approvals include an increase to the not-to-exceed amount of the Agreement by an additional $668,295.90, which includes: (1) the cost for the initial three-month extension ending April 30, 2016 not-to-exceed $222,765.30; and (2) if needed, the cost for the additional month-to-month extensions up to a six-month period beyond April 30, 2016 in an amount not-to-exceed $445,530.60 ($74,255.10 per month).  Sufficient funds are available in the City Council Adopted Budget for Fiscal Year 2015/2016 to fund the proposed expenditures.

 

 

RECOMMENDED MOTION(S):

 

That the City Council and Successor Agency Board:

 

1.                     Approve a fifth amendment to the Modern Parking Inc. agreement to (1) extend the term of the Agreement for an additional three months to April 30, 2016, (2) authorize the City Manager/Executive Director to approve additional extensions beyond April 30, 2016 on a month-to-month basis, not to exceed an additional six months; and (3) increase the not-to-exceed amount by an additional $668,295.90; and

 

2.                     Authorize the City Attorney/Successor Agency Counsel to prepare the necessary documents; and

 

3.                     Authorize the City Manager/Executive Director to execute such documents on behalf of the City and the Successor Agency.
