RECOMMENDATION:
Staff recommends the City Council: (1) award a construction contract to DLSB, Inc.
as the lowest responsive and responsible bidder to complete the necessary work for
the Eveward Road, Drakewood Avenue, Whitburn Avenue, Flaxton Street,
Blackwelder Street, Smiley Drive, Northgate Street, Cranks Road, Commonwealth
Alley, and Carson Street Sewer Improvement Projects (P-839, 840, 841, 842, 854,
855, 773, & 860)-;, and (2) approve a professional services agreement with APD
Consultants, Inc. for Construction Management and Inspection Services.
BACKGROUND:
The plans and specifications and the authorization for advertising for bids for the
aforementioned sewer improvement projects were approved by the City Council on
the following dates:
1. Eveward Road, Drakewood Avenue, Whitburn Avenue, & Flaxton Street
Sewer Improvement Projects, P-839, 840, 841, & 842 (August 22, 2005).
2. Blackwelder Street and Smiley Drive Sewer Improvement Projects, P-854
(August 14, 2006).
3. Northgate St and Cranks Rd Sewer Improvement Projects, P-855 (August 14,
2006).

On May 22, 2006, the City Council rejected the bids received for Eveward Road,
Drakewood Avenue, Whitburn Avenue, and Flaxton Street Sewer Improvement
Projects, P-839, 840, 841, & 842 due to bid results that greatly exceeded the budget.
The City Council was informed that staff will re-evaluate the Sewer Improvement
Project to determine the best possible cost savings. Also, in order to obtain more
favorable bids for construction, it was recommended to the City Council that the
project be advertised with other upcoming sewer improvement projects that were
currently in the design phase in order to generate a higher interest and greater
economy of scale.
Upon careful review of the project plans, it was determined that the reduction of the
length of the sewer laterals and usage of alternative backfill material were changes
that did not compromise the construction standards and diminish the quality of the
sewer improvement project. These design changes resulted in approximately a
$400,000 reduction in construction cost based on the revised engineer’s estimate.
Scope of Work
The scope of work for sewer improvements projects consist of the following:
On August 20, 2001, a Citywide Sewer Video Analysis and Condition Assessment
Study was conducted. This study was recently updated on June 29, 2004.
Approximately 85 miles of the City’s sewer lines were video inspected. The
Condition Assessment Study categorized the City’s sewer main lines into four
groups; “A”, “B”, “C”, & “D”. Group “A” represents the highest priority ranking for
replacement and Group “D” represents the lowest.
Based on the Conditions Assessment Study, the existing 6”, 8”, 10”, & 12” Vitrified
Clay Pipe (VCP) sewer mains along the following streets were classified as Group
“A”, the highest priority requiring replacement:
1. Eveward Road from Bernardo Road to Ranch Road; (8” VCP, 315 lf)
2. Drakewood Avenue from Ranch Road to Flaxton Avenue; (8” VCP, 775 lf)
3. Flaxton Avenue from Overland Avenue to Drakewood Avenue; (8” VCP, 1660 lf)
4. Whitburn Avenue from Overland Avenue to Drakewood Avenue; (8” VCP, 810 lf)
5. Blackwelder Street from La Cienega Blvd to Ballona Creek, (8” VCP; 1040 lf)
6. Smiley Drive from Fairfax Avenue of Ballona Creek, (10” VCP ; 860 lf)
7. Northgate Street from Overland Avenue to Drakewood Avenue, (8” VCP; 990 lf)
8. Cranks Road from Hill Road north to Cul-de-sac, (8” VCP; 915 lf)

The scope of work consists of the removal of the existing 6”, 8”, 10”, and 12” vitrified
clay pipe (VCP) and constructing new 8”, 10”, and 12” Polyvinyl Chloride (PVC)
sewer mains located at the above mentioned streets within the said limits. As part
of the improvements, all sewer laterals will be replaced with 6” PVC to the street
curb and minor pavement repairs will also be included. In street segments where no
street curbs exist, sewer laterals will extend up to the property line.
DISCUSSION:
On March 2, 2007, the Deputy City Clerk publicly opened bids. There were a total of
twenty-six (26) bid holders, with eleven (11) contractors responding with the
following bid amounts:

Staff reviewed the lowest bidder’s bid proposal (DLSB, Inc.) and found the bid
documents complete. The bonding information, contractor eligibility, and Worker’s
Compensation Insurance was reviewed and determined to meet City requirements.
DLSB, Inc. is a new company, but has completed several projects for other
municipal and county agencies, such as the City of Pico Rivera, Los Angeles County
Department of Public Works and Riverside County Flood Control & Water
Conservation District. A representative from the City of Pico Rivera indicated that
the Company performed in a professional manner, was very responsive and highly City of Culver City, California

recommended them for future projects. Also the personnel in the company have
many years of experience with pipeline construction working for other companies.
Based on a careful review of DLSB’s bid documents, reference checks, personnel
experience, and bonding and insurance requirements, staff is recommending
awarding the construction contract to DSLB, Inc.
Cost Savings due to Combined Bid
Combining the ten (10) sewer improvement projects in one bid resulted in a
significant cost savings to the City. The original bid, for example, for the Eveward
Road, Drakewood Avenue, Whitburn Avenue, and Flaxton Street Sewer
Improvement Project received in March 22, 2006 was in the amount of $1,827,810.
Based on the changes made to the project plans in April, 2006 and if the same unit
prices were used from the bid received, the new bid amount should have been
$1,427,810.
The current bid received from DLSB, Inc. for Eveward Road, Drakewood Avenue,
Whitburn Avenue, and Flaxton Street Sewer Improvement Project received was in
the amount of $941,069.20. Therefore, the combining of the several sewer
replacement projects further reduced the construction cost by another $486,741 for
this project.
The result of the combined project in general reduced the unit prices for the majority
of the costly bid items on the project, for example,
1. 8” PVC sewer main – approximately 68% less per linear foot
2. 6” PVC sewer lateral – approximately 45% less per linear foot
3. Asphalt – approximately 25% less per ton
Construction Management and Inspection Services
Under the Engineering Division’s supervision and project management, staff is
recommending that the construction management and construction inspection be
performed by APD Consultants, Inc (APD) at a not to exceed cost of $185,670.
A Request for Proposal was sent to the following consulting civil engineering firms
with experience in construction management and inspection of pipeline construction:

Based on the proposals received, staff believes APD can provide the best service at
the lowest hourly rate. Although a new company, their construction management
and inspection team has extensive working experience on municipal pipeline
projects. Staff from the City of Cypress and the City of Diamond Bar spoke
favorably of the proposed construction management and inspection team and would
recommend them for future projects.
The geotechnical construction services will be conducted by PSI Consultants, Inc.
for the construction observation, compaction testing, and roadway pavement
resurfacing testing under the approved general geotechnical services agreement
with the City. It is estimated that the cost will be about $85,860.
The start of construction will begin in May 2007 and is expected to be completed in
October 2007. All City Department and affected residents will be notified.

An additional $89,400 would be required to sufficiently fund the contingency of the
construction project.
Pursuant to the City Council adopted Budget Resolution, the City Manager can,
should the City Council award the contract as recommended, approve a budget
transfer in the amount of $89,400 from the Farragut and Elenda Sewer Improvement
Project, P-872 (20400872) to the project budget to adequately fund the contingency.
Funds not expended after the construction phase will be returned to the Farragut
and Elenda Sewer Improvement Project, P-872. The Farragut and Elenda project
has sufficient budget to cover the transfer.

Project Description
The work consists of removing the existing 8", 10", and 12" VCP and constructing a new
8", 10" and 12" PVC sewer main along the following streets,

The scope of work also includes , but is not limited to, the construction of house laterals,
manholes, roadway pavement, sidewalk, curb and gutter, and replacement of traffic
pavement markings as specified in the attached plans and specifications.
The construction of sewer improvement project is anticipated to begin May 1, 2007 with
construction duration of 180 calendar days.
Project Observations
APD has reviewed the Plans and Specifications of the project and observed the
followings:
• Water and Gas laterals generally not shown on the plans. Inspector and contractor
will need copy of utility companies sewer, water and gas atlas. Dig Alert (USA)
required to mark the field.
• Traffic Control - It appears the contractor will be required to obtain a public
works encroachment permit prior to beginning work in the public right-of-way. It
would be desirable to refer to this item in the Specifications and include estimated
permit fees and draft permit requirements in the Appendix. Permit requirements
could address items such as:
1) Temporary road closures if allowed during construction operations.
2) Detour requirements
3) If temporary storage or equipments and material in streets are allowed or not.
4) Lane closure - Specifying if and how many traffic lanes must remain open
during construction at all times.
5) Address who pays for traffic signal loop detector replacements.

Scope of Services
APD, in addition to all the items mentioned below, will:

Prepare Public Notice Forms for distribution to inform local residents of the
project and its duration.
• Perform video and picture survey prior to job construction.
•
Maintain project construction records in a 3-ring binder report and submit to the
City at the end of the project.
•
APD inspector will also conduct labor compliance interviews of contractor and
sub-contractors workers under the Construction Manager's supervision
• Respond to residents/publics inquiries and complaints
• Prepare Weekly Construction Manager's Report
• Recommend final acceptance of the project
APD Consultants, Inc. (APD) will be an extension to the City Staff and act as the City's
representative and will be accountable and responsible for successful
completion of the
project . As requested by the City for the purposes of this proposal, the construction
duration was assumed to be 180 calendar days, which is 126 business days taken into
consideration
Memorial day, 4th of July, and Labor day holidays. All estimates of billable
hours were based upon this duration.
A. CONSTRUCTION PHASE
1)
Conduct Pre-construction meeting with the General Contractor (GC). An
agenda shall be prepared by APD as approved by the City's Project
Manager.
2) Conduct weekly coordination meetings with the GC.
3)
Conduct daily site visits, observations, and supervise general inspection of
construction activity. APD's Construction Manager will have a complete
set of Plans, Specifications, Greenbook, and APWA Standard Plans at all
times.
4) APD'
s inspector will perform field inspections and coordinate
geotechnical testing during construction to insure compliance with plans,
specifications, and applicable standards. APD 's inspector will have a
complete set of construction plans, Specifications , Greenbook, and APWA
Standard Plans at all times.
5)
APD's inspector will coordinate testing requirements, review and approve
material and design mix submittals prior to placement. All tickets must be
retained and submitted to City's Project Manager by end of each work
week.

6) APD's inspector will conduct weekly progress meetings with GC and the
City's Project Manager, and resolve any job site difficulties in the City's
best interest. Prepare and distribute meeting minutes the following
business day.
7) Prepare Daily Construction Reports (DCR's). These DCR's will include a
detailed description of the day-to-day operations, including on-site labor,
personnel, weather, materials and equipment and include times of arrival
and departure. Please see attached a sample APD Daily Construction
Report in this proposal.
8) APD's inspector will document work progress on a regular basis by means
of digital photographs properly labeled and dated.
9) Review the GC's construction schedule (weekly) with respect to the
progress and any potential delays.
10) Coordinate with other City Departments as necessary.
11) Process and track Request for Information (RFI's)
12) Administer and negotiate changes to the work.
13) Maintain a log of RFI's and change order requests.
14) Coordinate the flow of information between all parties.
15) Review and provide recommendations for GC payments.
16) Provide weekly status reports and submit DCR's and construction photos
at the end of each week to the City's Project Manager.
17) Provide coordination necessary to assure that ADA requirements are
satisfied during construction progress and upon completion.
18) Coordinate invoicing and payment process with the City Project manager.
19) Ensure utility coordination throughout the construction phase of the
project is performed by the GC.
20) Administer the lien wavier process and review all conditional and
unconditional releases for consistency with all payments made.
21) Work with adjacent property owners ' and residents' to resolve their
concerns, review potential accessibility issues, and ensure installation of
traffic control devices per WATCH manual and as directed by City
officials.

B. CONSTRUCTION CLOSE OUT PHASE
1) Administer final inspections.
2) Coordinate fmal walk through inspection, prepare final punch list items,
and ensure all corrections items are completed by fmal close-out letter.
3) Verify removal, recordation notes, and replacement of all survey
monumentation.
4) Resolve any outstanding payment issues and stop payment orders, if any.
5) Make recommendation for the release of retention.
6) Coordination any close-out activities required by the City.
7) Review and make recommendations as to adequacy of as-built plans.

numerous State Highway improvement projects in Southern California. He is also
familiar with labor compliance requirements, and
will conduct labor compliance
interviews of contractor and sub-contractors workers under the Construction Manager's
supervision.
Mr. Brooks is very familiar with the construction of sewer projects, as well
as current design and construction practices. He has experience in construction
management, contract administration, project management, project development, project
design, and coordination with public agencies/utilities including railroads, cities,

Hamid Nourian - Inspector
Mr. Nourian will be a backup inspector for Mr. Brooks, when and if needed, due to

over 25 years of experience and has a B.S. in Civil Engineering. Mr. Nourian's

The scope of services provided included field surveying, street widening design,

Rollingwood Road. This "T" intersection is located near the Serrano intermediate

the addition of 78" RCP storm drain line, AC removal and replacement, addition of curbs
and gutters, hydrology and hydraulic analysis, design of catch basins, preparation of

Reconstruction of one mile Carbon Canyon Road through Caltrans encroachment permit

Construction Manager for two separate park improvement projects, valued at approximately $1
million. Amphitheater for outdoor performances has extensive landscaping, seating , stage, lighting,
security, walkways for outdoor performances. Involved fairly extensive grading. Value engineered to
save 45% on bid amount. Aquatic Park consists of interactive water fountains for children to play in,
ticket booths, and restroom facilities.
? City Health Facility Laboratory Upgrade, Long Beach, CA: CBM will upgrade and convert the
existing lab facilities, install new equipment, demo and erect new walls, construction will happen
under operating conditions requiring night shifts. HVAC extraction system, negative pressure in the
building.
? Computer Bindery Room, Long Beach, CA: CBM will install a dedicated power supply from the
central City Hall and main switch board to the computer room.
? Emergency Generator Replace and Upgrade for City Hall, Long Beach, CA: Upgrading the

Canyon Acres drive. The project is extremely challenging project because of it is one road with no
outlet feeding 60 houses and many of the utilities in the middle of the street need to be relocated.
PROJECT MANAGEMENT
? Point Vicente Interpretive Center, Rancho Palos Verdes , CA: Construction Manager for a whale
watching/ interpretive center located above the sea cliffs at Point Vicente on the Palos Verdes
Peninsular. There was an existing center that was closed several years ago, which is being
remodeled as part of the project and will be incorporated into the new center. The existing building
is 2,300ft and the new building 7,500. The structure is a combination of structural steel and wood
construction and includes an IT room. (Value $5M)
? Towne Park Redevelopment , Culver City Redevelopment Agency , CA: CBM facilitated and
project managed the redevelopment of the park into an open air pedestrian mall. Design included
water features, landscaping, lighting elements, decorative paving.

? Public Works Staff Assistance , La Canada Flintridge , CA: Project Manager. Assisted City staff
over a period of approximately one year for implementation of the annual overlay/slurry seal
program, annual sidewalk replacement program and new bus shelter program. Performed Public
Works Inspection and Public Relations to coordinate resident concerns on City projects.
? Verdugo Boulevard Realignment & Widening , La Canada Flintridge , CA: Project Management,
design and Construction Management for re-alignment and widening of Verdugo Blvd., including
relocation of 3 storm drain lines and appurtenant catch basins, maintenance holes, etc. Acted as
the main interface for community outreach and public relations for the project.
? Jessen Drive Re-alignment, La Canada Flintridge , CA: Project Management, design and
Construction Management . Coordinated and conducted public interviews with affected residents, a
public meeting.
Compiled construction documents, managed the bid process and construction

Project Manager. Represented Agency in developing concepts, dealing with problem solving,
reconstructing roads including Ince Blvd., and widening Washington Blvd. to accommodate the
changing traffic patterns due to Ince parking structure, and undertaking the construction
management with a large number of contractors involved. Project included new sidewalks, ADA
compliant ramps, landscape median islands, new traffic signals, relocating utilities, repaving
sidewalk enhancements, curb extensions, new crosswalks, traffic calming measures , and NTMP
work in the neighborhood.
? Utility Relocation and Contract Coordination , Culver City Redevelopment Agency, CA:
Project Manager. Facilitated and coordinated utility relocation projects for two high-profile projects
in
Downtown Culver City. Successfully negotiated participation by the utility companies without cost
to the public agencies. Negotiated scheduling and coordination of the construction phase to
facilitate a new auto dealership and a new multi-block commercial development as part of the City's
redevelopment program.
? Pedestrian and Crosswalk Improvements Phase II: Broadway , Wilshire, Ocean Park and
Santa Monica Blvd., Santa Monica , CA: Project Manager. Involved from inception of the project,
coordinating the aerial survey for the base maps, design input, PS&E checks. The project is
currently under construction and will be completed in mid 2003. The $5 million project is basically
streetscape improvements, with curb extensions and median construction with the associated
drainage modifications necessary. It also includes striping, general landscaping, lighting upgrade
and traffic light installation. There have been considerable negotiations with various departments
within the city and dealing with the design engineers and their sub-consultants.
? Pedestrian and Crosswalk Improvements Phase I : Ocean , Montana and Neilson, Santa
Monica , CA: Project Manager. Involved in two projects of similar nature from design input, through
plan checks to the coordination and inspection of the work. Project involved streetscape
improvements, median and general landscaping, lighting upgrade, traffic light installation and

Manager. Involved with the concept design for the upgrade of the area and the specific streetscape
design involving the installation of streetlights, landscaping, sidewalk replacement and street print of
newly laid asphalt. Prepared the specifications, obtained approval from the Redevelopment Agency,
managed the inspection, and received bids to do the work.

Construction observation and survey control for the installation of a CDS Technologies, Inc.
pollution trap and appurtenant components and improvements at the intersection of 20th Street and
Walnut Avenue.
? Spring Street Revitalization Corridor , Signal Hill, CA: CM inspection. The project consists of
widening, a full removal and reconstruction of the roadway, lowering the grade crest, parkway
improvements, intersection improvements, traffic signal upgrades and new installations, and

PROJECT UNDERSTANDING
The City of Culver City is seeking the services of a professional Construction Management and
Inspection services firm to complete sewer improvements consisting of replacing the existing VCP
sewer main and constructing a new PVC pipe sewer main such at multiple sites throughout the city.
The scope of work includes the reconstruction of house laterals, manholes, roadway pavement,
sidewalk, curb and gutter, and replacement of traffic markings as specified in the plans and
specifications. Construction duration is expected to begin May 1, 2007 and run for 180 calendar days.
APPROACH
The CBM team firmly believes that the key to a successful project is more than just performing tasks
outlined in a scope of work. Any competent team can follow a set of written guidelines. The key to a
successful project is performing each task with a realistic and clear understanding of what the real
intent of the project is and constructing the final product with a "win-win" attitude.
Management of any construction project requires a proactive approach with talented staff. CBM owes
the successful completion of over 400 projects, with no unresolved claims, to our ability to find and
maintain excellent professional staff, and our dedication to organization, documentation and the
proactive management of the construction process. Our keen understanding of, and experience with
the public process and the public construction contract administration also results in a smoother project

contractor and maintain the project on track for successful completion, on time and within budget.
A successful project is built by fostering good relationships and trust between the design team, client
agencies and the Contractor. Before our team can begin to accomplish its goals, we must first
understand the viewpoints of not only the involved agencies, but also the viewpoints of the Designers,
Contractors, the general public and other affected project stakeholders. We must have the ability to
analyze critical situations from all viewpoints and work with the Project Team to develop the best
solution. The CBM team understands these varying viewpoints because we have worked for and/or
managed design consultants, contractors and several public agencies.
CBM Consulting, Inc. has devoted over 15 years to providing project and construction management
exclusively to public agencies. Our construction management, budget and schedule tracking systems,
and our entire organizational structure are geared to providing flexible services to our clients. We have
extensive experience in construction management of public projects, and we understand the unique
and important differences between public and private projects. CBM managers are well known to our
clients as "solution makers", we proactively identify the important issues - then work with the team to
expeditiously implement solutions most beneficial to the project.
Management Approach
The CBM Approach starts with the end in mind. The end being a quality project delivered on time and
within budget. The CBM process begins with the development of the main project elements: master
project schedule, master project budget and the comprehensive scope of work. These elements are not
developed in a vacuum, but rather with all project stakeholders to ensure that no surprises are
encountered during the project. This provides a sense of order among project stakeholders and project
team such that the entire team is focused on the same goals.

CBM uses a wide range of systems, depending on the client's project need and budget. From simple,
time-tested forms and procedures to the state of the art in CM and web-based systems, CBM delivers
small and large projects on-time and under budget, while keeping our Client up to date on a "real-time"
basis.
Potential Construction Challenges
Safety: First and foremost, CBM always considers safety the most important issue on any construction
project. CBM will recommend key safety provisions to require the contractor to have competent safety
personnel and site specific safety programs employed on the project at all times. CBM will monitor the
Contractor's operations for compliance with the project safety requirements.
Protocol and Communication: Timely and concise communications are essential to the successful
completion of any construction project. CBM will be the primary point of communications. All
communications and correspondence will be handled in a professional and respectful manner.
Typically, all project documentation will be scanned and digitized for expeditious distribution via email).
All correspondence is logged and tracked, and linked to its respective issues for quick retrieval. CBM
also offers set-up and maintenance of a project web-site for regular project status updates, as an
additional optional scope item.
Project Phasing: The specifications require specific phasing be implemented. CBM has extensive
experience working with contractors to facilitate critical phasing requirements on complex projects.
Temporary and Permanent Utilities: Early and continuous coordination with utilities is imperative to
ensure timely availability of temporary and permanent services. CBM has extensive experience
assisting contractors in dealing with local utilities on complex utility coordination projects.
Storm Water Pollution Prevention Plan: The CBM team is well versed at verifying best management
practices and monitoring establishment, maintenance and modification of SWPPP measures on
complex multi-phase projects.
Substitutions and Submittals: Timely procurement of materials and equipment for any building
construction project is imperative. By submitting its bid, the Contractor is indicating it can successfully
procure and construct the necessary components within the allotted time. CBM will establish a
detailed, subsection by subsection submittal log at the beginning of the project and work with the
Contractor to tie all submittals and procurement of materials and equipment into the schedule. CBM
will continuously monitor that the contractor submits each item in a timely manner and that the review
and approval of each item is not unnecessarily delayed by the City and/or A/E review process.
Responses will be clearly documented to note the contractor's failure to meet specification
requirements, thereby maintaining the contractor's responsibility to meet the contract completion
deadline. Any substitution requests will only be processed for consideration if the item is considered
equal or a substantial savings can be identified with little or no degradation to the quality or function
intended for the specified item.
Requests for Information (RFIs): CBM will receive review, and process responses to contractor RFIs.
Contractors typically utilize the RFI process to initiate changes on construction contracts. CBM will
review all RFls and clearly document that responses are clarification and that no additional cost or time

will be considered. Should a response to an RFI appear to potentially impact cost or time, CBM will
identify and recommend the most cost and quality effective alternatives to the City and expedite
implementation with the Contractor.
Change Management / Claims resolution: CBM will implement its time tested claims management
process to minimize changes to the project and avoid claims such that the project can be quickly and
successfully closed out. CBM has done so on over 400 public projects valued and approximately $1
billion with no unresolved claims. The basis for CBM procedures is a well organized documentation
system, a keen understanding of the construction process, exceptionally qualified staff and fair and firm
negotiations. CBM will not defer difficult issues and will process only change issues that have been
analyzed and determined to have merit. Those items will only be recommended for consideration when
the most reasonable cost and time has been negotiated and all alternatives to avoid the impact have
been resolved.
Quality Control
The primary objective of CBM's quality control program is to ensure that quality work is performed
consistent with the Owner's expectations, in accordance with contract drawings and specifications, and
in compliance with applicable regulations and restrictions.
CBM utilizes the state-of-the-art in computerized contract administration systems. CBM has made a
substantial investment to customize industry proven, off the shelf computer programs for utilization on
public projects in Southern California. CBM has successfully used this system on several large public
projects in Southern California.
Part of the customization of the contract administration database utilizes quality control reports to verify
that documents control procedures are implemented and maintained correctly.
CBM's monthly CM quality control checklist includes, but is not limited to the following:

SCOPE OF SERVICES
CBM will serve as the City's representative and liaison with the City Project Manager and City
Engineer, as well as, the Contractor during the construction of the project. Prior to the pre-construction
meeting, CBM will review and be knowledgeable of the contract documents, as well as, be
knowledgeable of existing site and conditions. Particular attention will be given to value engineering,
CBM will review the construction documentation and identify any potential cost saving alternatives for
the project. Additionally, after the pre-construction meeting , CBM will review and coordinate an analysis
of the Contractor's submittals with the design team, as well as comment of the Contractor's schedule if
necessary.
Constructability Review of Bid Documents:
CBM will review the plans for bidability and constructability and identify potential value engineering
solutions, ambiguities, conflicts and/or omissions apparent during its review. The Bid documents and
technical specifications will also be reviewed for potential duplication/overlap of clauses, conflicts,
proper placement of critical requirements within the order and precedence of documents.
Preconstruction Conference: CBM will coordinate and conduct the Pre-Construction Meeting including
notification to contractor, utility agencies, and other stakeholders, and prepare the meeting agenda and
minutes.
The agenda and minutes will include the following items, at a minimum:

CBM considers the pre-construction meeting as progress meeting #1. All items discussed are
designated as "open" or "closed". All open items are carried forward to subsequent progress meetings
until resolved and closed. Action items are assigned a specific responsible party and a deadline for
resolution. Each progress meeting is clearly minuted and distributed to all attendees and affected
coordination parties. CBM will also conduct all site meetings. Pre-construction meeting and site meeting
minutes will be distributed via fax and / or email to meeting participants and to courtesy recipients
identified by the City.
Daily Construction Observation Reports: CBM and/or its deputy inspection subconsultant will compile
daily observation reports documenting the contractor's workforce, material and equipment used, a
summary of construction activities, field problems, disputes or claims, resolutions of issues and
directions given to the contractor. Completed daily reports will be transmitted to the City on a weekly
basis.
Periodic Progress Reports: If desired by the City, CBM will cooperatively develop, with the Project
Stakeholders, the format and information required for reports that may be required during the
construction phase. These reports are typically compiled every other month and include the following
information:

• Summarized report of construction activities including significant events and accomplished
goals

• The latest detailed 4 Week Look Ahead Schedule submitted by the Contractor and reviewed by
CBM
• Identification and discussion of current problems or pending change orders and actions taken or
planned to resolve such issues
• A discussion of new short and long term goals for the project
• A comparison of Actual vs. Planned budget expenditures
• A Master Trend Log detailing potential and approved changes
• Report of progress payments made to date and invoices in process
• Labor Compliance Reports for Contractor and Subcontractor employees (if required)
• A QA/QC section prepared by the Team addressing testing and regulatory compliance issues
• An analysis of change order impacts or potential problems on schedule and budget
Submittal Processing: CBM will track all correspondence and submittals on this project. CBM will
receive all Contractor submittals and review them for completeness and general conformance with the
contract documents. All shop drawings, samples and other submittals received from the Contractor will
be logged in and routed to the City and the Architect. Responses will be logged in and transmitted to
the Contractor. Submittals will be tracked throughout the project to ensure timely response in order to
avoid Contractor claims for delay. All Submittals will be expedited utilizing electronic delivery
whenever possible (except for shop drawings, large format documents, etc.). Additionally, CBM will
recommend key contractual requirements for the Contractor to clearly indicate submittal processing
requirements in the project schedule. Submittal comments will be monitored to identify potential
impacts to quality, cost or schedule, with recommended alternatives and/or solutions.
RFI's: Upon receipt, CBM will log, distribute and respond to each Request for Information (RFI) as
required. It is anticipated that most will be handled upon receipt. However, in the event that the design
engineer or the City staff are required to answer questions, the project manager will coordinate a timely
resolution. CBM will identify potential impacts to cost or time that may result due to issues identified in
RFIs, with recommended alternatives or solutions to mitigate the potential impacts.
Weekly Statement of Working Days: CBM will prepare a weekly statement of working days
documenting the construction progress, time of completion, delays and time extensions, and submit to
Contractor and the City on a weekly basis. The weekly statement of working days is typically discussed
and agreed upon at each progress meeting and transmitted as an attachment to the minutes.
Problems and Solutions: CBM'S proactive approach serves to anticipate and expeditiously resolve field
problems. Our team is well trained in problem solving. All issues are processed with a sense of
urgency and presented to the City with suggested alternatives, cost and schedule impacts and
recommended solutions. CBM will quickly implement the alternative, which suits the best interests of
the project and the City.

CBM will effectively and expeditiously communicate with City staff, Design Consultants and the
Contractor to identify conflicts construction problems, coordination issues, and will obtain the needed
action and response to submittals and RFI's.
Document Tracking System:
Complete and current project files shall be kept at the job site, or at a location agreeable to the City,
and shall be available to the City at all times. These files will consist of the contract, correspondence
relating to or modifying the contract, proposal requests, clarifications, permits, logs, reports, RFI's, field
orders, change orders, claims inspection reports, test reports, etc. CBM has a detailed file indexing
system for all project hard files, and a contract administration database customized for public works
agency construction management for management of digital data and scanned documents. CBM has
already developed customized forms, reports database structure, and work breakdown structure, well
suited for this project. We will adapt our system to the specific needs of the project, to monitor, track
and control the project. This detailed tracking system will enable us to provide an accurate assessment
of the progress to the City with recommendations to maintain or improve adherence to the approved
project schedule.
Schedule Review: CBM is intimately familiar with all of the main stream scheduling software utilized by
the public works contracting industry, including, but not limited to Primavera P3® Suretrak® and
Microsoft Project®. CBM will review the baseline construction schedule, including activity sequences
and duration, schedule of submittals and schedule of delivery for products with long lead-times. The
CBM team will evaluate the baseline project schedule for the following:
• Consistency with the contract schedule (completion within the contract time)
• Accurate start dates, completion dates, other dates detailed in the contract
• Any impacts of weather and change orders
• Sufficient detail - including submittal process and
procurement requirements
• Sequence of construction and correct schedule logic
• Identification of the critical path and project float
The schedule will not be approved as the baseline until all
discrepancies are resolved.
Schedule Control: During the progress of construction, CBM

Photographs: Prepare and maintain an electronic photo journal documenting the construction progress.
Photos shall be taken before construction begins, during construction and upon completion of the
project.

Contract Conformance: CBM's Construction Observer will be full time on site the normal working hours
and when critical activities require to verify construction progress and to verify that all work conforms to
contract requirements.
Deputy and special inspection and materials sampling and testing will be
coordinated and provided as required by the final plans and specifications. CBM's will reject work that
does not conform to the requirements of the contract documents and will promptly report unacceptable
work to the City and contractor. Rejected work will be thoroughly documented, photographed, and
tracked until repaired or replaced to the satisfaction of the City.
Coordination with City: CBM will monitor closely the work of the contractor. The contractor will be
required to submit a 4-week look ahead schedule at the weekly meetings. This is a very effective tool in
helping to coordinate the construction operation, particularly in relation any interface operations with the
City's activities.
CBM will assist the City to minimize disruption to both City and construction
operations.
Safe Conditions: CBM will monitor project work and adjacent areas for unsafe conditions, promptly
require corrective measures to be addressed by the Contractor in compliance with the contract
documents and report such issues and corrective measures taken to the City.
SWPPP: CBM will enforce all provisions of the Storm Water Pollution Prevention Plan. At a minimum
SWPPP requirements will be monitored and a specific SWPPP Checklist will be compiled. Any
deficiencies noted will be addressed with the contractor for immediate remedy. Upon a weather report
of 40% (or higher) expectancy of rain, a site walk will be conducted to ensure that SWPPP measures
are in place and well maintained.
Materials and Workmanship: CBM will recommend approval of materials and workmanship that meet
the contract requirements, in coordination with the authority of the consulting engineer, architect, fire
inspector,
deputy inspector, or other authorized representative or regulatory authorities having
jurisdiction.
Documentation Interpretation & Technical Assistance: CBM will perform the coordination and
expediting between the contractor, design team and City Staff to clarify any questions for interpretation
of the construction documents. Timely, firm and fair determinations will be processed to minimize cost
and time impacts to the project.
QA/QC:
CBM will enforce the quality assurance plan, in conformance with the City' s Quality Assurance
Manual . CBM will coordinate QA/QC activities
on a daily basis and review activities as they happen, to
make sure that QA/QC procedures
are followed and deficiencies are resolved in a timely and efficient
manner. The CM will maintain a chronological log of all records.
Special, Deputy and Soils Inspection and Materials Testing:
CBM has a working relationship with most of the local soils, deputy inspection and material testing
firms.
Upon determination of the specific special, deputy and soils inspection and testing requirements,
CBM will develop the required scope of services engage the necessary services for the QC on the
project.
An allowance for special, deputy and soils inspection and testing services is recommended in the
proposed fee. The actual amount will be coordinated and determined upon completion of the plans and

specifications, and coordination with building and safety for determination of the final requirements for
the project.
Testing and Observations: CBM will coordinate laboratory, jobsite, offsite testing of construction
materials
and required observations per construction documents, construction codes, and Jurisdictional
Agencies. CBM will implement established procedures for testing as required per the construction
documents. CBM will monitor testing services, track documentation and record
testing results in weekly
construction progress meetings.
When necessary, CBM will require and track that corrective
measures
are implemented and re-inspected to verify acceptable completion.
Change Orders: CBM will establish, implement and coordinate systems for processing all contract
change orders. Each issue ,
which is identified as a potential change to the design, scope, cost or
contract time will generate
change notice. CBM will determine whether or not a change notice should
be considered. The plans and specifications will be reviewed
against the change notice. If the issue
does not appear to be included in the plans
or specifications, a Request for Quotation (RFQ) will be
sent to the Contractor. Any credits for work deleted
as a result of the change will be required at this
time as well.
The contractor's response to the RFQ will be evaluated for reasonableness and
completeness. CBM will maintain a Trend Log, listing potential
changes as identified, either formally or
informally.
This Trend Log shall be used such that potential change items are not overlooked or
deferred until the end of the job. CBM will prepare independent cost estimates as required for contract
change orders.
Upon approval by the City, CBM will prepare, log and process change orders for full
execution, and administer their implementation.
Once fully executed, CBM will review the timely
completion of the work and coordinate inclusion of the change order in the appropriate payment
application.

Daily Extra Work Reports: CBM will verify and sign contractor's daily extra work reports documenting
force account (time & materials) work. In particular, CBM will monitor that only appropriate worker
classifications necessary for approved time and materials work is included on extra work reports. Any
inappropriate workforce and/or equipment charges will be promptly rejected and removed from extra
work reports.
Progress Payment Processing: A cost control system, based on the Contractor's schedule of values,
approved change orders and the contract amount shall be developed and implemented to monitor
progress costs. Monthly cost reports will be submitted to the City as a component of the Monthly
Progress Report.
CBM will review the payment applications submitted by the contractor and determine whether the
amount requested reflects the progress of the contractor's work.

payment application will be required by the contractor.
When the payment application is acceptable
and all backup documentation is verified (certified payrolls
, lien releases , etc.), CBM will prepare and
forward to the City a Progress Payment Report.
The Report shall state the total contract price,
payments to date, current payment requested,
retainage and actual amounts owed for the current
period.
The CBM team is experienced evaluating complex pay applications. It is critical to the City's
best interest that payment application review be performed accurately and prudently to maintain the
prime and subcontractor incentives to perform on the projects.
Construction Meetings ,
Schedule and Conduct Field Meetings: The following meetings will be held on
site:
Periodic Progress Meetings with agencies, design team and staff to discuss all data included in the
monthly progress reports and focus on the following items:
• Progress during the period
• Major decisions made
• Planned vs. actual schedule
• Upcoming work schedule
• Current or unresolved problems
• Anticipated or pending change orders

Impacts of problems or change orders on schedule and budget
• Discussion of new goals
• Planned vs. actual budget analysis

Scheduled concurrent with a weekly meeting to save time and cost
Weekly Progress Meetings will be mandatory for the Contractor and staff, and optional or on an as
needed basis for City and design team staff. All parties are always invited to attend in person or via
remote. Meeting
minutes are distributed to all team members whether in attendance or not.
Discussions will focus on the following items:
• Contractor's detailed 4 week look-ahead schedule
• Progress and major decisions during the last week
• Update of unresolved items from previous meetings
• Status of submittals and change orders
Special Meetings will be scheduled as needed to discuss important issues or which require detailed
discussion or review of plans and specifications. These meetings will follow the weekly meeting to
reduce trips, if issues are not urgent.
Written Instruction: CBM will Issue written instructions to contractor regarding routine matters and/or
follow-up of verbal instructions as necessary to properly document project issues.
Plans, Specs and As-Builts: At a minimum, CBM will periodically review the Contractor's as-built
updates on the approved job plan set, identify missing items and require the Contractor to keep as-built
records up to date throughout the project. At the City's option CBM will keep its own set of as-built
plans which will note the location of subsurface utilities encountered and / or installed, identify where
any design or field changes were required (utilizing the corresponding RFI and / or change order
numbers) and note the location of critical building components that are covered by finish work. At the
end of the project the final as-built plans are submitted the City within thirty days of construction
completion.

Proposal
Pre-Final Inspection: The Construction Manager and Construction Observer will perform the final job
walk and prepare the punchlist (deficiency list). CBM will coordinate and observe completion of
required corrections. Should the Contractor lag on a portion of the completion of project work, CBM will
estimate the value of the incomplete items and recommend specific retainage in accordance with the
contract to preserve the City's interest. If necessary, a change order will be recommended for approval
for completion of the remaining work such that the City may file the notice of completion and start the
time after which stop notices and/or claims are no longer valid.
CBM will schedule and perform quality assurance materials testing to verify compliance of the work with
the contract documents. We will review test reports submitted by others to substantiate compliance and
ensure that Certificates of Compliance or source release tags are furnished by the Contractor along
with the applicable delivered materials at the project site.
Final Inspection: All corrections must be made before CBM recommends processing of the "Notice of
Completion". CBM is noted for our attention to detail. Not only have we excelled at closing out our own
projects, but we have been requested to and successfully closed out problem client projects where our
services were not initially utilized.
Upon completion of the punchlist and final sign off by all project stakeholders, CBM will make
recommendation to City regarding Contractors final progress payment request and prepare final
progress payment report for submission to City.
Delivery of As-Builts and close -out documents : CBM will review "as-constructed " plans and prepare
"as-constructed " reports . CBM will assist the Contractor in maintaining a field set of "as-constructed"
plans to be updated daily and delivered to the City upon project completion . CBM will continually
document changed field conditions and not rely on the Contractor to document "as-constructed"
conditions . The will report and photograph field condition changes . The CM will document and keep
these "as-constructed" conditions on plans in his office . CBM will review the Contractor 's submittal of
"as-constructed " conditions and compare this submittal to CBM's own documentation . Discrepancies
will be discussed , resolved and recorded . Completed "as-constructed " plans will be submitted to the
City.
CBM will enforce the provisions of the specifications to require the Contractor to submit well
coordinated operations and maintenance manuals, warrantees & guarantees, bonds, extra stock and/or
other items required by the contract documents such that a timely close-out of the project is
implemented.
CBM will perform closeout duties including final organization of project files and submit to the City for
final approval, and assist with the filing of the notice of completion and release of retention.
ADA Requirements : CBM will provide coordination necessary to assure that ADA requirements are
satisfied during construction progress and upon completion.
Utility Coordination: CBM will ensure utility coordination throughout the construction phase of the
project is performed by the GC.

Lien Waivers: CBM will administer the lien waiver process and review all conditional and unconditional
releases for consistency with all payments made.
Coordination with Residents and Property : CBM will work with adjacent property owners ' and residents'
to resolve their concerns, review potential accessibility issues , and ensure installation of traffic control
devices per approved traffic control plans . This is a key element in any construction effort and will be
especially important as residents will be impacted by periodic closures.
Monumentation
CBM will verify removal , recordation notes , and replacement of all monumentation.
Review construction traffic control
CBM will review construction traffic control to ensure the optimum situation with regard to the following:
Protection of the public both pedestrian and vehicular, during the construction operation.
Arrange the traffic control so that there is minimal disruption to traffic and access to local business

Provide for the optimal phasing of the traffic control to facilitate the efficient completion of the

CRITICAL ISSUES
The plans and specifications have been reviewed by CBM staff to identify the critical issues for each
work zone . These items are of particular interest and will be given special attention during construction.
It goes without saying that safety is the number one critical issue in any construction zone, and it will be
the first and foremost concern in all of these areas.
All of these new lines are being installed in dense residential and industrial neighborhoods.

RATES & FEE
ASSUMPTIONS:
1. The level of effort and fee estimate detailed above is based on CBM's proposed scope of services
delivered over the contract time set forth in the construction bid documents. The tasks outlined in the
fee reflect the requirements in the Request For Proposals.
2. The fee assumes that construction phase services begin and end within the contract completion
time.
3. Additional scope of services not listed in the proposal or extended schedule for reasons outside of
CBM's control would require additional effort and fee. Over time and weekend rates will be billed at
time-and-a-half.
4. Soils inspection and testing , deputy and special inspection and testing , and/or QA/control surveying
are excluded from the fee proposal . CBM will coordinate these services performed by others unless
otherwise desired by the City.
5. The fee estimate assumes CBM will perform CM activities from CBM headquarters office in Gardena
with requisite site visits. No onsite facilities, furniture, utilities or equipment are included in the fee.
6. Project expenses are billed at cost plus 10%. Project expenses include: Non-commuter automobile
mileage (at $.50 per mile), postage and special courier expenses, subsistence, reproduction, project
related telephone, subcontractor services and other direct project expenses as requested by the client.
Should the client desire, phone and mileage may be included in an hourly rate, which shall be
negotiated and slightly higher than the billable rates indicated above.

The Nickerson Company is a California Corporation, established in September, 2001. The firm
provides construction management, and inspection service for public and private agencies.
Vernon Nickerson the principal-in-charge is a former Culver City Public Works Inspection
Supervisor who successfully served the City for nearly 18 years before his service retirement in
2001.
Since much of his experience is within the boundaries of Culver City,
he is a credible and familiar
face to the local residents, City departments, and utility companies. His unique experience in
working in the Public Works Department benefits the City in developing a comprehensive and
successful approach to the project. The Nickerson Company will
act as an extension of the City's
staff. The project will be structured so as to maintain open communication with the City, design
engineers, contractor, and pertinent regulating agencies.
Our services will be personally directed by the principal-in-charge who has superior knowledge
and experience in the project areas with the excavation issues and with local residents. We will
anticipate and keep ahead of key issues with intent to ease the impact of construction on local
residents and will minimize down time by anticipating problems/change conditions and present
solutions to the city in a timely manner.

Total fees as indicated are based upon the estimated time requirements for a construction period of
180 days with one full-time Construction Inspector plus one part-time Construction Manager. These
fully burdened rates include all vehicle, cell phone, computer, and inspection equipment charges.

Material testing and construction
staking are not included. The standard hourly rates shown above includes payment of prevailing
wages for inspection as required by law, and Certified Payrolls will be provided upon request. The
hourly rate for overtime inspection (nights and weekends) is 1.35 times the standard rate. Construction
Management overtime is provided at the same hourly rate as shown above.
There will be no
additional charges for "reimbursables" such as mileage or travel time. Invoicing of fees will be based
on the level of effort actually required to properly administer and inspect the project. If the level of
effort is less than the estimate, the City will be invoiced accordingly. Should additional services be
required to accomplish project objectives, said services will be provided following prior notification of
and approval by the Nickerson Company and Culver City.
