RECOMMENDATION:
Staff recommends that the City Council accept the work as complete by the
contractor, Thomsen Landscape, and authorize filing the Notice of Completion for
the Syd Kronenthal Park Playground Resurfacing Project, P-831. It is also
recommended that the City Council authorize staff to obtain “Unconditional Release”
forms from the contractor and its subcontractors and suppliers so that the retention
funds in the amount of $4,386.00 may be released to the contractor in order to meet
the April 12
th
California Integrated Waste Management Board (CIWMB) grant
deadline for the settlement of all outstanding accounts.
BACKGROUND:
The Syd Kronenthal Park Resurfacing Project was performed to address pavement
and drainage deficiencies. The scope of work consisted of:
• removal of the existing concrete and sand;
• installation of recycled rubberized asphalt.
The original contract amount for the project was $43,320.00 and the final contract
amount was $43,860.00. The $540.00 in change orders (1.25% of the contract
amount) was due to the addition of a drain.
In order to qualify for reimbursement from the California Integrated Waste
Management Board grant, all accounts related to this project must be settled by April
12, 2006. For this reason, staff is recommending that ‘Unconditional Release’ forms
be executed by the contractor (Thomsen Landscape) and its subcontractors and
suppliers. This would allow the City to release the retention immediately in-lieu of

waiting 35 days after filing a Notice of Completion with the County Recorder as is
our standard practice
FISCAL ANALYSIS:
There were sufficient funds in the Fiscal Year 2005/06 Capital Improvement budget
to finance this project. The City received a California Integrated Waste Management
Board (CIWMB) Playground Cover Grant in the amount of $25,000 and appropriated
$20,000 of the City’s Proposition 12 Per Capita Funds for the project.
The CIWMB grant requires that all construction be completed and reimbursement
requests be finalized not later than April 12, 2006. The end of the performance
period for the Proposition 12 Per Capita grant is June 30, 2008.
It is anticipated that this Park improvement project will have no significant impact on
the ongoing maintenance and operational costs for Syd Kronenthal Park.

That the City Council:
1) Accept the work performed by the Contractor, Thomsen Landscape for the Syd
Kronenthal Park Playground Resurfacing Project, P-831;
2) Accept the Unconditional Release Forms submitted by Thomsen Landscape, its
Subcontractors and suppliers; and
3) Authorize the release of the 10% contract retention amount ($4,386.00) to
Thomsen Landscape, immediately in-lieu of the 35-day lien period following filing
of the Notice of Completion
