RECOMMENDATION:
Staff recommends the City Council accept the work performed by the contractor,
EAR Engineering, Construction & Support Services, and authorize filing a Notice of
Completion for the Fire Station #1 Underground Storage Tank Modification Project,
CIP-844.
BACKGROUND/DISCUSSION:
On February 27, 2006, the City Council awarded a construction contract to
EAR Engineering, Construction & Support Services (“EAR”) for the modification of
underground storage tank (UST) components at Fire Station #1, including the
following environmental compliance modifications: installation of an Enhanced Vapor
Recovery system for the unleaded fuel tank, upgrade of audio/visual fill alarm
systems, replacement of spill containment sumps, and reconstruction of the concrete
tank pad and lids to avert water seeping from onsite Fire Department operations.
Due to the favorable low bid, the City Council also authorized staff to negotiate
additional work not to exceed a total project budget of $79,916.00.
EAR completed the project on 12/28/06. The original base contract amount for the
project was $72,651 plus a 10% additional contingency of $7,265. Two (2) change
orders were issued during the project. However, Staff identified discrepancies in
proposed changes to the project scope, and a credit was subsequently issued by
EAR to the City. The final construction cost was $71,287.50, a savings of
$1,363.50.

The project was designed, managed, and inspected by Transportation Department
UST Operations staff, Engineering Division staff and Fire Department staff. Funds in
the amount of 20% of the contract value ($14,530.20) were held until satisfactory
inspection and acceptance of all components was achieved, systems were deemed
to be successfully tested, and were confirmed as environmentally compliant.
Transportation Staff was not familiar with the City’s acceptance of work process, and
released these funds to EAR prior to the City Council’s authorization. We apologize
for this oversight; completion of any future projects will be handled appropriately.
FISCAL ANALYSIS:
Sufficient Capital funding was appropriated for this project in Fiscal Year 2005-06
and in Fiscal year 2006-07 within the Capital Improvement Program budget for the
Citywide UST Modification Project, P-844 (Account # 42000844.730100).

2) Authorize the issuance of a Notice of Completion;

to the Los Angeles County Recorder’s Office.
