RECOMMENDATION:
That the City Council: 1) adopt the Ordinance (Attachment 1) amending Chapter
15.02, Buildings, Structures and Equipment, of Title 15 of the Culver City Municipal
Code relating to administrative assessments and authority to issue orders to comply;
and 2) adopt the Resolution (Attachment 2) establishing a schedule of administrative
assessments. (The Ordinance does not require a first reading because it was
already introduced, for first reading, on January 26, 2004, as discussed in further
detail below.)
BACKGROUND/DISCUSSION:
At the City Council meeting of January 26, 2004, the City Council introduced, by a
unanimous vote (5-0), an Ordinance relating to administrative assessments and
authority to issue orders to comply, and adopted Resolution No. 2004-R005
establishing a fee structure for the assessments (Attachment 3). A copy of the
Agenda Item Report and meeting minutes for this matter are included as
Attachments 4 and 5, respectively. Due to an oversight, the Ordinance was never
brought back for adoption. This fact was not discovered until recently when Building
Safety had occasion to implement these assessment provisions. Although
Resolution No. 2004-R005 was adopted that evening, it does not become effective
until the Ordinance takes effect. After the Ordinance was introduced, it was issued
an ordinance number (Ordinance No. 2004-002), which was also recorded on the
Resolution with regard to its effective date.

As a result, the Ordinance is brought back tonight for adoption. Please note the
Ordinance has been modified to reflect a new number, proper formatting, clarifying
language, and the correction of non-substantive grammatical and typographical
errors. In addition, the Resolution is brought back for a technical revision reflecting
the new Ordinance number, as well as the inclusion of certain clarifying language.
FISCAL ANALYSIS
As previously discussed when the Ordinance was initially introduced and the
Resolution was adopted, due to the nature of the relationships that Culver City
Building Safety Division staff has with those involved in building activities, it is not
expected that these assessments will be administered frequently. However, in
certain instances, staff has needed additional tools for enforcement efforts and the
imposition of administrative assessments would assist staff in gaining compliance
with the City’s Municipal Code. When an administrative assessment is imposed, the
funds collected would provide for the recovery of costs incurred by the Building
Safety Division in such enforcement efforts.

WHEREAS, certain Building Safety Division staff are currently authorized to

28§ 15 02 900 ADMINISTRATIVE ASSESSMENT COST RECOVERY
PROGRAM
The City Council hereby finds and determines that it is appropriate and
necessary to require the recovery of costs incurred by the City in the administrative
enforcement of Section 9 07 035 of this Code, Chapter 15 02 of this Code, including,
but not limited to, the adopted California Building, Mechanical, Electrical and
Plumbing Codes, Chapters 1503, 15 04 and 15 05 of this Code, Title 17 of this
Code, any and all final conditions of approval imposed on a construction project
pursuant to this Code, and any other provisions of this Code authorized by resolution
of the City Council
§ 15 02 905 IMPOSITION OF ASSESSMENTS
A Violation It shall be unlawful for any person to fail to comply
with any Order to Comply issued by the Culver City Building Safety Division
B Violation corrected When an Order to Comply has been
satisfied within the time period prescribed, as confirmed by inspection or other
proof acceptable to the Building Official, no administrative assessment shall
be imposed
C Violation not corrected When an Order to Comply has not been
satisfied within the time period prescribed, as confirmed by inspection or other
proof acceptable to the Building Official, an administrative assessment,
established by resolution of the City Council, shall be imposed on the person
named in the Order to Comply for each additional compliance inspection
required until such time as the Order to Comply has been satisfied
2§ 15 02 910 APPEALS
The initial Order to Comply, identified as an "initial warning," cannot be
appealed Subsequent Orders to Comply may be appealed to the Municipal
Code Appeals Committee To contest subsequent Orders to Comply and
their respective administrative assessments, a written objection must be filed
with the Building Safety Division office within ten (10) days of receipt of the
appealable Order to Comply The Building Safety Division will notify each
appellant of the date and time of the scheduled hearing
§ 15 02 915 REMEDIES NOT EXCLUSIVE
The imposition of an administrative assessment, as set forth in this
subchapter, is not mutually exclusive of the provisions set forth in § 15 02 005
of this Chapter, or any other applicable provisions of this Code or federal,
state or local laws, and does not prevent the use of concurrent or consecutive
remedies to achieve compliance with this Code
SECTION 2 Pursuant to Section 512 of the City Charter, this
Ordinance shall take effect thirty (30) days after the date of its adoption Pursuant to
Sections 514 and 517 of the City Charter, prior to the expiration of fifteen (15) days after
the adoption, the City Clerk shall cause this Ordinance, or a summary thereof, to be
published in the Culver City News and shall post this Ordinance, or a summary thereof, in
at least three (3) places within the City
SECTION 3 The City Council hereby declares that, if any provision, section,
subsection, paragraph, sentence, phrase or word of this ordinance is rendered or declared
invalid or unconstitutional by any final action in a court of competent jurisdiction or by

WHEREAS, the City of Culver City desires that the aggressive
administrative enforcement of the City's Building Code be self supporting, and
WHEREAS, the City Council has considered the estimated costs incurred
by the City for administrative enforcement of the City's Building Code, and
WHEREAS, when Building Code violations are corrected promptly the
administrative cost of enforcement is less and
WHEREAS, when Building Code violations are continuing and repetitive,
the costs of obtaining compliance increase, and
WHEREAS, on August 8, 2005, at a duly noticed public meeting, the City
Council considered the adoption of a schedule of administrative assessments in order
to recover the cost of such enforcement efforts, and
WHEREAS, after giving the public an opportunity to be heard and
considering all information before it, the City Council approved the schedule of
administrative assessments, and
WHEREAS, the assessments established herein are based upon the
reasonable cost incurred by the City in enforcing its Building Code
NOW, THEREFORE, the City Council of the City of Culver City, California,

PROCEDURE

BACKGROUND
Administrative Assessments
Currently Building Safety Fire Prevention and Code Enforcement are the
three City divisions that have been granted the authority to enforce and issue

assessments for Orders to Comply for certain violations of the CCMC This
authority was established through Culver City Resolution No 95-R 041 which
was approved in 1995 This resolution allows for the Building Safety Division
to issue Orders to Comply for violations of the CCMC which relate to Building
Codes, business license regulations and smoking in certain places Staff
proposes that the Building Safety staff also be allowed to issue an Order to
Comply' for violations of
• The state mandated California Building Codes, including all
California Title 24 requirements,
• CCMC Section 9 07 035 Construction
• CCMC Title 15 Land Usage
• CCMC Title 17 Zoning and
• Violations of final Conditions of Approval (for those projects that
have completed a Planning Division Discretionary Review and are
issued Conditions of Approval)
It is not intended that the increased areas of responsibility for Building Safety
usurp the responsibilities of Fire Prevention or Code Enforcement
Although Resolution No 95-R 041 established what the Building Safety staff is
authorized to enforce and issue citations, this resolution did not establish the
allowable cost of these assessments Resolution No XXX proposes that the
assessments be imposed in the following manner
Where the violation has not been corrected within the time period
prescribed by the Building Department, any additional compliance
inspection shall be assessed to the violator at an administrative charge of
One Hundred Dollars ($100 00) for the first additional inspection If
compliance is still not achieved, a further administrative charge of Five
Hundred Dollars ($500 00) per each inspection shall be assessed
Staff believes that these fees are reasonable from a cost recovery viewpoint
because the current cost to the City for a building safety inspector, including
all indirect costs is approximately $40 00 per hour In order for staff to follow
through on violations of Orders to Comply, staff time will include inspections,
logging violations, re-inspections to verify compliance, and updating the status
of the construction permits and inspections in the computer system and files
The hours that it will take to perform these tasks at a cost of approximately
$40 00 per hour will be recovered with the proposed assessment charges

DISCUSSION
Administrative Assessments
Staff proposes that Chapter 15 02 be amended to establish expanded areas
for which the Building Safety Division can issue Orders to Comply and
administrative assessments when the violations associated with these
Order(s) to Comply are not remedied The process that the Building Safety
Division would follow is modeled after the process established in CCMC
9 02 300 that outlines how the Fire Prevention Division can administer
administrative assessments
These proposed procedures are outlined on the back of the Order to Comply
form and are summarized as follows
Procedures
1 An initial Order to Comply is issued, which establishes the time period for
the violation to be corrected The initial warning carries no monetary
assessment
2 If the violation is not corrected within the 1 st prescribed time period,
an administrative assessment established by Council Resolution No XXX
is charged
3 If compliance is still not achieved, a further administrative charge is
assessed for each additional inspection This assessment is established
by Council Resolution
All projects that complete a Planning Discretionary Review will include text in
the Final Conditions of Approval notifying the applicant that any violations of
the Conditions of Approval may be subject to administrative assessments

along with the record of the Vote thereon Additionally, the City Clerk shall post a
summary of this Ordinance in at least three public places within the City pursuant to
Section 517 of the City Charter

RESOLUTION NO 2004-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CULVER CITY, CALIFORNIA, ADOPTING A SCHEDULE OF
ADMINISTRATIVE ASSESSMENTS FOR THE RECOVERY
OF COSTS AND EXPENSES INCURRED BY THE CITY FOR
THE ENFORCEMENT OF ITS BUILDING CODE
WHEREAS, the City of Culver City desires aggressive administrative
enforcement of the City's Building Code be self supporting, and
WHEREAS, the City Council has considered the estimated costs and
expenses incurred by the City for administrative enforcement of the City's Building
Code, and
WHEREAS when Building Code violations are corrected promptly, the
administrative cost of enforcement is less, and
WHEREAS, when Building Code violations are continuing and repetitive the
costs of obtaining compliance increase
NOW THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY RESOLVE as follows|109| Pursuant to Culver City Municipal Code § 15 02 905 (C), the City
Council hereby adopts the following schedule of administrative assessments as reasonable
costs of enforcement of the City s Building Code
