City of Culver City, California Agenda Item Report RECOMMENDATION: Staff recommends that the City Council introduce an Ordinance (Attachment 1) amending Section 11.12.010.B of the Culver City Municipal Code (CCMC) to ratify and memorialize the intent of the review process used for approval and issuance of oil drilling permits. BACKGROUND / DISCUSSION: The existing provisions of Chapter 11.12 of the CCMC require the City Council’s consideration and determination whether permits should be issued to allow the drilling, re-drilling or deepening of any well hole (collectively, “drilling”). Chapter 11.12 of the CCMC sets forth the requirements pertaining to such permits and related applications. Among other things, subsection 11.12.040 A. of the CCMC specifically requires any applicant for an oil permit to sign an agreement obligating that applicant to comply with all conditions imposed on the permit. In addition, subsection 11.12.010.B. provides as follows: “On receipt of an application, the City Council may require further information of the applicant or from City Officers or Commissions, and in no event shall a permit be issued unless the City's zoning regulations have been adhered to.” (Emphasis added.) For example, during the processing of the oil drilling permits most recently granted by Culver City (in 2002), the City Council considered and imposed, as part of the permit review process, discretionary conditions on the grant of those permits (Attachment 2). The City Council included conditions not explicitly stated in Chapter 11.12 and evaluated the permit applications under the California Environmental Quality Act, which evaluation is required only with regard to discretionary actions (Attachment 3). Such a permit can be issued only after the City Council has used its discretion to determine, at a duly noticed public meeting, whether to approve, deny or conditionally approve that permit. The City is in the process of reviewing, studying, and revising the City’s laws, rules, procedures and fees relating to oil and/or gas operations, including its zoning laws, to adequately and appropriately balance the rights of existing operators and future applicants who wish to operate in the City with the preservation of the health, safety and welfare of the communities surrounding such oil and/or gas operations under Ordinance No. 2009-008. However, that process is not yet complete and circumstances make it desirable to ratify and memorialize the intent of the review process used under the existing law. A recent applicant has contended Chapter 11.12 provides that the City Council’s consideration of whether or not to issue those permits is a ministerial determination. The purpose of the proposed Ordinance is to ratify the intent of the subject regulations and to memorialize the City’s administrative history and past practices, by amending CCMC Section 11.12.010.B. to read as follows: “On receipt of an application, the City Council may require further information of the applicant or from City Officers or Commissions, and in no event shall a permit be issued unless the City's zoning regulations have been adhered to. The issuance of an oil drilling permit, and the determination of conditions that should be included therein for the protection of health, safety, and welfare, are subject to the discretion of the City Council.” Staff recommends that the City Council introduce the proposed Ordinance in order to ratify the intent of the existing oil permit processing provisions of Chapter 11.12 of the CCMC and memorialize the City’s administrative history and past practice regarding that process. PERMIT TO DRILL OIL WELLS, PURSUANT TO THE PROVISIONS OF CHAPTER 11.12 OF THE CULVER CITY MUNICIPAL CODE. (Oil Well Drilling Permit, OWDP-P-2001092 for Stocker Resources, Inc.) WHEREAS, Chapter 11.12. of the Culver City Municipal Code ("CCMC") provides an application for oil drilling permit shall be submitted to the City Council for approval; WHEREAS, on February 1, 2002 Stocker Resource's, Inc. (the "Applicant') filed application for a permit to drill operate and maintain two (2) oil producing wells on the "Texaco-Vickers Lease" dating back to April 18, 1924 (the "Npplication"); WHEREAS, in accordance with the CEQA, the City Council finds this project to be a Class three (3), "New Construction or Conversion of Small Structures", Categorical Exemption; and WHEREAS, on , March 25, 2002, at a duly noticed public meeting the City Council considered the Application and all related evidence and testimony presented. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CULVER CITY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Based on the evidence, testimony and racommerdations made by the City staff regarding the Application, for the City Council, being fully informed, hereby finds and determines: 1. The Application has been processed in accordance withal] proceedings required under Chapter 11.12 of the CCMC and the Applicant has paid the required Seven Hundred Fifty Dollars ($750) application fee per well. 2. The Applicant has expressed its willingness to enter into an agreement, as provided by Section 11.12.040 of the CGIvIG, which is attached hereto and incorporated herein by reference (the 'Agreement"). Based on the foregoing -findings and determinations, the applicant is hereby granted the permits to drill the proposed wells subject to the follbwing financial conditions: 1. A payment of a permit fee of Two Thousand Five Hu id red Dollars ($2,500) per well; 2. A public liability insurance policy with One Million Dollare ($1,000,000) limit per well; 3. A properly damage insurance policy with One Million Dollars ($1,000,000) limit per well; 4. A performance bond Of One Hundred Thousand Dollars ($100,000) per well, maintained in full force and effect (i) during the time of drilling, operating and Maintenance activities are conducted pursuant to this permit and (ii) for a period of five (5) years Mowing the termination or revocation of this permit, or following the abandonment of the well, whichever is later. The bond shall provide sufficient financial guarantee (1) for the satisfactory completion of removal, dismantling and demolition of any structures, related to the permitted oil wells, which will be erected pursuant to this permit whenever .drilling, operating and maintenance activities are abandoned or cease and (ii) for the payment of all costs in leaving, the premises upon which the oil wells are placed in its original condition, free from oil, rotary mud, oil-soaked earth, asphalt, concrete, fitter, debris and other substances caused by the oil drilling or pumping activity. On every. ten-year (10-year) anniversary date of this resolution, the amount , of the bond shall be adjusted by the aggregate increase in the local consumer price index over the immediately preceding ten-year 00-year) period. Any derricks used in the drilling operations shall be removed within ninety (90) days after the completion of drilling the well holes; 4. All waste disposal activities shall be conducted in compliance with appropriate regulations of the County's Industrial Waste Division, which shall include obtaining Em industrial waste permit; 5. Permittee shall give prompt notice to the City Clerk of any and all accidents 19 occurring as a result of Permittee's operation or on the Properly. 20 4_ Permittee will keep on file with the City Clerk during drilling operations under the permit, a 21 certificate or certificates of insurance duly executed by Permittee's insurance carrier or 22 carriers, which shali serve as evidence of the continued existence in full force and effect of 23 required insurance policies. 24 5_ Permittee will carry on and conduct the operations authorized under the permit so as to 25 . cause the least possible annoyance -and inconvenience to the general public and to 26 properties, individuals and industries in the adjacent neighborhoods. Perrnittee will comply 27 with the noise regulation provisions of the Culver City Municipal Code and use best efforts 28 29 Page 21 to resolve, satisfactorily and timely, all reasonable noise complaints of which it is notified or aware.|1010|6. The project is an essentially flat, previously graded dirt pad measuring approximately 110' in width by 300' in depth off an existing oilfield road. The site already contains one producing gas well (TVIC 268) and one producing oil well (TVIC 200), and is surrounded by numerous other wells, being part of the 480-well Inglewood Oil Field which has produced since the mid-1920's. The soil is stable, and there are no plants or animals, nor any cultural, historical or scenic aspects. There are no structures other than a temporary housing trailer that will be removed following completion of Stocker's ongoing 22-well drilling program, which includes 20 wells in the adjacent area of unincorporated Los Angeles County. 9. The area surrounding the project site is essentially comprised of rolling hills containing the 480-well Inglewood Oilfield, with the developed edge of the City of Culver City starting below, about 2000' to the Northwest. The hills are spottily covered with native vegetation and non-native, noxious common plants. There are no known sensitive, threatened or endangered plant or animal species in the surrounding vicinity (reference Kenneth Hahn Park Preliminary General Plan Amendment — July 2001). There are no known cultural, historical or scenic aspects. The proposed adjacent land use will be the drilling of more development wells and production of oil and gas from the same for an expected economic life of 20 to 30 years. The nearest property under consideration for surface development is the 12-acre Westways parcel on Jefferson Boulevard below, which is going through conceptual design review for tilt-up commercial or storage facilities. The project consists of directionally drilling two developmental oil wells to precisely located bottom-hole locations that will yield previously undeveloped oil reserves. Following actual drilling time per well of approximately 72 consecutive hours with a drilling rig, the wells will be completed by running a production string of casing and installing an electrically powered pumping unit. The produced oil and water will be transported by new flow lines and joined with existing field production in existing facilities and separated. The water will be re-injected into the producing formation to maintain reservoir energy, and the oil sold via buried pipelines running south to the local refineries in Wilmington. Please refer to the plot plan of the drilling rig, and the production facilities layout previously furnished with Stocker's application to drill these two wells. No new separators or tanks will be built in conjunction with these wells. Production operations will include periodic, multiple daily visual checks of the site on daily rounds by Stocker's lease operators.
