RECOMMENDATION:
Staff recommends the City Council approve an amendment to the professional
services agreements with Nickerson Company and APD Consultants to support the
Public Works Department/Engineering Division for general public works inspection,
for an aggregate not-to-exceed amount of $100,000 with the agreements expiring on
June 30, 2009.
BACKGROUND:
The Public Works Department/Engineering Division operating budget includes
consultant support for general public works inspection. There has been a marked
increase in the number of large projects in the private development sector such as
Fox Hills Mall renovation/expansion, Sony Studios new office buildings and parking
structure adjacent to Culver Boulevard and Motor Avenue, and Culver Studios
expansion. Also there are potential projects such as the Entrada project (subject to
pending City Council action), 9900 Culver Boulevard development, and other
redevelopment projects. All these projects include new sewer installations to serve
the developments. Each private development paid or will pay sewer facilities
charges and inspection charges for the new sewer construction. In order to provide
effective and efficient public works inspection services on these large projects, utility
companies’ work, and other private development, it is proposed that consultant
inspection services continue to supplement the existing full time public works
inspector. This arrangement has worked successfully over the past three fiscal
years and it is recommended that it continue for the fourth fiscal year.

On September 24, 2007, the City Council approved amending the existing contract
with Nickerson Company and awarding a new contract with APD Consultants for
general public works inspection services. Staff has utilized Nickerson Company to
provide the inspection services at $80 an hour. Vern Nickerson of Nickerson
Company of Manhattan Beach, a retired Culver City Senior Public Works Inspector,
has been conducting these general public works inspections. He has successfully
conducted all of the public works inspection services on the Symantec project.
Another company, APD Consultants, has inspectors available that have experience
in municipal inspection services. They are available on-call for immediate support.
Their billing rate is $85 an hour. Also both Nickerson Company and APD
Consultants have City Council approved contracts to provide support for
construction management and inspection services for the capital improvement
program.
The approved $65,000 in the operating budget this fiscal year for consulting
inspection services will be exhausted this month. In order to provide sufficient
funding to the end of the fiscal year and secure contract extensions with the
favorable hourly rates until the end of the next fiscal year, Staff is recommending
extending the professional services agreements with Nickerson Company and APD
Consultants, respectively, for the general public works inspection services. The
proposed agreements will expire on June 30, 2009. The agreements will share an
aggregate not-to-exceed cost of $100,000. The City retains the right to terminate
the agreement upon thirty days’ notice at any time during the term of agreement.
Also, the City will have the right to contract with other inspectors when it is in the
City’s best interest.
FISCAL ANALYSIS:
Nickerson Company’s hourly rate charge for public works inspection services is $80
an hour. APD Consultants hourly rate charge for public works inspection services is
$85 an hour. $25,000 of the total $100,000 aggregate amount of the agreements is
needed for the remainder of this fiscal year and is proposed to be funded through
the sewer enterprise fund (20466100.619800, which has sufficient funding...The
remainder of the contract ($75,000) will be considered in the proposed 2008-09
budget and is proposed to be funded 50% in the Public Works Department -
Engineering Division operating budget (i.e. $37,500 in 10160500) and 50% in the
Sewer Fund (i.e. $37,500 in 20466100).
Per the adopted fee resolution, Public Works charges inspection fees to the
applicants to offset the cost of using these contract inspection services. .

MOTIONS:
That the City Council:
1. Approve amendments to the professional services agreements with
Nickerson Company and APD Consultants, for general public works
inspection services for a total aggregate not-to-exceed cost of $100,000,
expiring on June 30, 2009.
2. Authorize the City Attorney to review/prepare the necessary documents and
authorize the City Manager to execute such documents on behalf of the City.
