RECOMMENDATION
Staff recommends that the City Council adopt a resolution designating agents by
title authorized to execute applications and other related documents for and on
behalf of the City of Culver City for financial assistance from the Federal
Emergency Management Agency (FEMA) and the state Emergency Management
Agency (CAL EMA) for recovering costs associated with declared emergencies.
BACKGROUND
The Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988,
codified at 42 U.S.C. sections 5121-5207 (the “Stafford Act”), provides the
authority for the federal government to respond to declared disasters and
emergencies in order to provide assistance to save lives and to protect public
health, safety, property and the environment. In addition, the Stafford Act
authorizes the President of the United States to make contributions to state and
local governments to help repair or reconstruct public facilities, to pay for
emergency response, and to provide grants for the development of plans and
programs for disaster preparedness.
To be eligible for reimbursement of costs associated with declared emergencies, a
resolution of the governing body of the municipality must be filed with CAL EMA.
CAL EMA has recently passed a new policy requiring forms and authorizations to
be updated and re-adopted every three years. The City has not previously City of Culver City, California

adopted this type of universal resolution. In the past, the City adopted a resolution
for disaster reimbursement, but it was specific to one incident (Resolution 2005-
R011, pertaining to a hillside slope failure).
DISCUSSION
The adoption of this resolution grants authority to the individuals in designated City
positions to apply for financial assistance and reimbursement applications for the
purpose of obtaining certain federal and financial assistance made available by the
Stafford Act, and/or state financial assistance under the California Disaster
Assistance Act, and to file the same with the State Emergency Management
Agency on behalf of the City of Culver City.
The State will not authorize reimbursement to the City for cost of disaster
expenditures until a resolution is filed.
Staff recommends that the City Council adopt the proposed resolution, which
designates the positions of City Manager, Assistant City Manager, Chief Financial
Officer, Fire Chief and Police Chief, and any of their designees, to execute
financial assistance and reimbursement applications. The resolution assumes that
these proposed authorized agents will abide by all assurances and agreements as
stated in the project application for the California Disaster Assistance Act Program
as provided by the state of California Emergency Management Agency.
FISCAL IMPACT
Without the adoption of this resolution, state and federal funds specifically targeting
disaster response, reconstruction and rebuilding efforts could be delayed.

AUTHORIZED TO EXECUTE APPLICATIONS AND OTHER
RELATED DOCUMENTS FOR AND ON BEHALF OF THE
CITY OF CULVER CITY FOR FINANCIAL ASSISTANCE
FROM THE FEDERAL EMERGENCY AGENCY AND THE
STATE EMERGENCY MANAGEMENT AGENCY FOR
RECOVERING COSTS ASSOCIATED WITH DECLARED
EMERGENCIES
WHEREAS, the Robert T. Stafford Disaster Relief and Emergency
Assistance Act of 1988, codified at 42 U.S.C. sections 5121-5207 (the
"Stafford Act"), provides the authority for the federal government to
respond to declared disasters and emergencies in order to provide
assistance to save lives and to protect public health, safety, property and

WHEREAS, the Stafford Act authorizes the President of the United
States to make contributions to state and local governments to help repair
or reconstruct public facilities, to pay for emergency response, and to
provide grants for the development of plans and programs for disaster
preparedness; and
WHEREAS, to be eligible for reimbursement of costs associated
with declared emergencies, the City must file a resolution with the State of
California Emergency Management Agency (CAL EMA) every three years,
authorizing designated employees by title to execute applications and
other related documents for the purpose of obtaining certain federal
financial assistance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
CULVER CITY DOES HEREBY RESOLVE AS FOLLOWS:

Section 1 The City Manager, Assistant City Manager, Chief
Financial Officer, Fire Chief and Police Chief, and any of their designees, are
each hereby authorized, acting alone or together, to execute for and on
behalf of the City of Culver City, a public entity established under its Charter
and the laws of the state of California, applications for the purpose of
obtaining certain federal financial assistance under Public Law 93-288 as
amended by the Robert T. Stafford Disaster Relief and Emergency
Assistance Act of 1988, and/or state assistance under the California Disaster
Assistance Act, and to file the same with the State Emergency Management
Agency.
Section 2. The City of Culver City hereby authorizes its agents
specified in Section 1 above to provide all required assurances and
agreements to the State Emergency Management Agency for all mafters
pertaining to state disaster assistance.
Section 3. The City Clerk shall send a certified copy of this
resolution to the State of California Emergency Management Agency.
Section 4. This resolution shall become effective as of the date of
execution.
