RECOMMENDATION:
Staff recommends the City Council adopt a resolution reciting the fact of the General
Municipal Election held on April 10, 2012 and stating the results of such Election.
BACKGROUND/DISCUSSION:
Section 1500 of the City Charter states, in pertinent part:
General municipal elections for the filling of all elective offices, other than
the Board of Education, shall be held in the City on the second Tuesday in
April in each even numbered year.
Section 1503 of the City Charter states:
Unless otherwise provided by this Charter, all City elections shall be held
in accordance with applicable provisions of the then current State law.
Elections Code Sections 10263 and 10264 provide:
10263. Upon the completion of the canvass and before installing the new
officers, the governing body shall adopt a resolution reciting the fact of the
election and the other matters that are enumerated in Section 10264. The
governing body shall declare elected the persons for whom the highest
number of votes was cast for each office. (a) Except as provided in

subdivision (b), the governing body shall meet at its usual place of
meeting no later than the fourth Friday after the election to declare the
results and to install the newly elected officers. (b) For a consolidated
election, the governing body shall meet at its usual place of meeting no
later than the next regularly scheduled city council meeting following
presentation of the 28-day canvass of the returns, or at a special meeting
called for this purpose, to declare the results and to install the newly
elected officers.
10264. As soon as the result of the election is declared, the elections
official of the governing body shall enter on its records a statement of the
result. The statement shall show:
(a) The whole number of votes cast in the City.
(b) The names of the persons voted for.
(c) The measures voted upon.
(d) For what office each person was voted for.
(e) The number of votes given at each precinct to each person
and for and against each measure.
(f) The number of votes given in the City to each person and for
and against each measure.
Pursuant to the City Charter and Resolution 2011-R087 adopted by the City Council
on October 24, 2011, the General Municipal Election was held on Tuesday, April 10,
2012. At that Election, four members of the City Council were elected, three of
whom were elected to a full term of four years (Mr. Weissman, Ms. Sahli-Wells, and
Mr. O’Leary) and one of whom was elected to an unexpired term of approximately
two years (Mr. Clarke). Additionally, Measure X, a proposal to increase the
Transient Occupancy Tax from 12% to 14% placed on the ballot by the City Council,
was PASSED with 83.4% of voters voting YES.
The City Clerk, in consultation with the City Attorney, has prepared the resolution
declaring the results of the election held on Tuesday, April 10, 2012, and declares
other matters as are provided for by law.
